The reason I chose this link is because in the U.S. mutual funds pass on to their shareholders the tax consequences of profits or losses on sales of securities that underly the mutual fund share price. If you, as an investor in a mutual fund, are responsible for paying tax on capital gains from the sale of the underlying asset, then you are considered to be a beneficial owner of the underlying asset. Now think of it in terms of those 100,000 CDs. As an investor in the fund that owns those 100,000 CDs, you have beneficial ownership rights in those CDs. Among those beneficial rights are the rights conferred by Fair Use.
