PBS Food’s Healthy Recipe Contest
No Purchase Necessary
1. Contest Description:
“PBS Food’s Healthy Recipe Contest” (the “Contest”) is sponsored by the Public Broadcasting Service, with its principal place of business located at 2100 Crystal Drive, Arlington, VA 22202 (“Sponsor” or “PBS”). The contest commences at 12:00:01 AM Pacific Standard Time (“PST”) January 9, 2012 and ends at 11:59:59 PM PST on January 29, 2011. Contest is void where prohibited or restricted by law. By entering the Contest, each entrant accepts and agrees to be bound by these official Contest rules (the “Official Rules”).
To be eligible, an entrant must be a legal resident of the fifty (50) United States, the District of Columbia, (excluding residents of Puerto Rico and US Territories and possessions). Employees, their immediate family members (i.e., parents, spouse, children, siblings, grandparents, step parents, step children and step siblings and their respective spouses, regardless of where they reside) of employees of PBS, or its public television member stations, and members of the same household, whether or not related to Sponsor, and each of their respective parents, affiliated companies, sponsors, subsidiaries, advertising and promotion agencies and third party fulfillment or judging agencies (collectively, the “Promotion Entities”) are not eligible to enter or win the Contest. No purchase is necessary. Must be 18 years of age or older to enter.
3. How To Enter: Entrant (“Entrant”) may visit www.pbs.org/food (the “Website”) at any time during the Promotion Period and and: (a) follow on-screen instructions to enter by completing all required fields on the Website; (b) electronically agree to the Official Rules and; (c) follow on-screen instructions to enter an original recipe that you have created. Recipes must include recipe name, directions, list of ingredients and may include one optional non-professional photo of the prepared recipe (“Entries” or “Entry”). Contest entry is limited to one (1) recipe per person, per email address, per promotional period. All Contest Entries must be received by 11:59:59 PM PST on January 29, 2012.
More than one (1) entry from the same person/email address will be disqualified. Entries from teams of people will be disqualified. Any use of robotic, repetitive, automatic, programmed or similar entry methods or agents will void all Contest Entries made by, or associated with, the applicable Entrant. In the event of a dispute over who submitted a Contest Entry, the authorized subscriber of the e-mail account provided in connection with the Contest Entry, as of the actual time of entry, will be deemed to be the Entrant. The “authorized account subscriber” is defined as the natural person who is assigned an e-mail address by an Internet access provider, online service provider or other organization (e.g. business, education, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
Recipe and Photo Submission Guidelines:
A. The Entry must contain Entrant’s property only; no other person’s property may be depicted in the Entry, in whole or in part. Please do not include any personally identifiable information in your Entry.
B. Entry photo may be in color or black & white and must be in .jpg, .gif, or .png format only, with a maximum file size of 1MB, and that photo has been taken by entrant (non-professional).
C. Entry must be in the English language.
D. Participants agree to and understand that Entries will be made available to the public, including without limitation, posting on the Internet. Whether or not Entries are published on the Internet, Sponsor does not covenant or guarantee any confidentiality with respect to any Entry.
E. Each Entry must be an original creation of the submitting Participant which is under no restriction, contractual or otherwise, that will prevent Sponsor’s use of the Entry and each Entry must be free of any and all liens, encumbrances and claims of third parties. Participant acknowledges, agrees and warrants that, nothing in the Entry infringes on any copyrights, confidential information, trade secrets or trademarks belonging to any person or entity other than the Participant absent a suitable license, clearance or permission agreement (proof of which is required upon submission), or violates any person’s rights of privacy or publicity and that all necessary releases and permissions have been secured. Participant agrees to indemnify and hold harmless Sponsor, and each of its owners, officers, directors, employees, franchisees and affiliated organizations, and their respective officers, directors and employees, from and against any and all claims, demands, damages, costs, liabilities and causes of action of whatsoever nature that are based upon or arise out of any breach by Participant of these Official Rules or the warranties and representations made by Participant in this paragraph. Modifying, enhancing or altering a third party’s preexisting work does not qualify as Entrant’s original creation.
F. The Entry may not have been submitted previously in any contest of any kind or exhibited or displayed publicly (i.e., disclosed beyond your immediate circle of friends and family) through any means previously.
G. By uploading the Entry the Participant agrees, for zero compensation, to grant to Sponsor all intellectual property rights in the Entry and each of its constituent parts, which rights include, without limitation, the Sponsor’s right to publish, make available to the public and/or reproduce the Entry through any media available at any time during, or after, the Promotion Period on any related websites, in any promotional materials, whether related or un-related to the Promotion, and at any other location, whether physical or online, that Sponsor, in its sole discretion, deems appropriate and necessary for the operation and promotion of this Promotion. In addition, Participant warrants that any so called “moral rights” in the Entry have been waived and Participant acknowledges and agrees that Sponsor may use any ideas from any Entry or other submitted materials, whether or not Participant has been awarded a prize in connection with any such Entry or other materials. Participant agrees to release, defend, indemnify and hold harmless each Sponsor, and each of their owners, employees, directors, officers, agents, franchisees, subcontractors, and licensees from all claims, demands, and causes of action of any nature whatsoever which Participant or Participant’s heirs, representatives, executors, administrators, or any other persons acting on Participant’s behalf or on behalf of Participant’s estate, have or may have by reason of: (i) Sponsor’s exercise of any rights granted by Participant in this paragraph; (ii) claims based on violation of any right of publicity or rights of personality, infringement of copyright or trademark, libel, slander, defamation, invasion of privacy, loss of earnings or potential earnings in connection with Sponsor’s use of the Entry and any portion thereof, or the likeness of any natural person therein.
H. Sponsor is not responsible for any expenses incurred in the production and delivery of the Entries.
II. Entry Content Restrictions: Entries must not contain material that:
a. Violates or infringes another’s rights, including without limitation, privacy, publicity or intellectual property rights, or that constitutes copyright infringement;
b. Contains material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
c. Contains any unacceptable clothing or adornments, or any commercial/corporate advertising other than that of Sponsor (including but not limited to corporate logos, brand names, trademarks, slogans, political, personal and religious statements);
d. Contains indecent or unsafe behavior or situations, including but not limited to nudity, or pornography, profanities or obscenities, or is otherwise inappropriate, indecent, profane, obscene, hateful, tortuous, slanderous or libelous;
e. References persons or organizations without their written permission;
f. Disparages any persons or organizations associated with Sponsor;
g. Includes threats to any person, place, business, or group;
h. Is unlawful, in violation of or contrary to all applicable federal, state, or local laws and regulations.
i. Failure of any Entry to comply with the above “Entry Requirements” and “Entry Content Restrictions,” as determined by Sponsor, in its sole discretion, may result in disqualification of Entrant. Without limitation, Sponsor reserves the right in its sole discretion to disqualify any Contest Entry that, in their sole opinion, refers, depicts or in any way reflects negatively upon the Sponsor, the Promotion or any other person or entity, does not comply with these Official Rules or if Sponsor receives notification about any potential infringements or breaches of law or any other reason set forth herein. All Entries shall become the exclusive property of Sponsor and will not be returned. Entries must be suitable for presentation in a public forum, in sole determination of judges and/or Sponsor.
4. Judging: On or about January 30, 2012, twelve (12) recipes will be selected (each, a “Grand Prize Winner”) by a qualified panel of judges (“Judges”) designated by SPONSOR based on the judging criteria (“Judging Criteria”) set forth below. The Judges, whose decisions will be final, shall judge the Entries according to the following Judging Criteria:
- 34% based on the Appeal of the Recipe,
- 33% based on Healthiness of the recipe, and
- 33% based on Originality of recipe.
In the event of a tie, the person among the tied Entrants with the highest score in Appeal of the Recipe will be a Finalist. Sponsor reserves the right to select fewer than twelve (12) Grand Prize winners if, in its sole discretion, it does not receive a sufficient number of eligible and qualified entries.
5. Prizes: There are exactly twelve (12) prizes total, (each, a “Grand Prize”) available to be won in the Promotion. Exactly one (1) Grand Prize will be awarded to each Grand Prize Winner. The Grand Prize shall consist of a Wüsthof Classic 8” Cook’s Knife.
The total approximate retail value of all Grand Prizes available to be won in this Promotion is $1,800 USD.
Any difference between the actual retail value and approximate retail value of the prize will not be awarded. PBS will notify each Grand Prize winner by February 28, 2012.
Winning entrant will be given seven (7) days to confirm their acceptance of the Grand Prize. Winning entrant must notify an administrator by sending a confirmation e-mail and may need to complete and return a signed affidavit of eligibility and a liability release form without modification. Winners will be solely responsible for any and all local, state, and federal taxes incurred by their participation in the contest. Prizes may not be exchanged for cash or any other consideration. Sponsor will report any individual winnings over $600 (in cash or fair market value of goods or services) in a one (1) year period to the Internal Revenue Service. Winners will receive a Form 1099 from Sponsor if Sponsor reports any winnings to the Internal Revenue Service.
Conditions and Limitations Apply:
a. Sponsor reserves the right to edit photographs or recipes submitted.
b. Sponsor is not responsible for lost, late, or misdirected entries, including due to network failure.
c. Sponsor reserves the right to use any information submitted by entrants for any purpose whatsoever.
d. All winners agree to the use of their names and likenesses in publicity without notice or any additional compensation, except where prohibited by law. By entering this contest, the winners acknowledge that Sponsor has the right to publicize and broadcast their name, voice, and likeness, the fact that they won, and all matters incidental thereto. Sponsor is not obligated to attribute submissions to their entrant.
e. By entering this promotion, each entrant forever discharges and releases Sponsor and its respective directors, officers, employees, agents, and subsidiaries from any and all liability, claims, causes of action, suits, and demands of any kind arising from or in connection with the promotion.
f. These rules are subject to modification by Sponsor in its sole discretion.
g. An entrant is not a winner unless and until entrant’s eligibility has been verified and entrant has been notified that verification is complete. In the event that a winner is determined to be ineligible, his or her prize will be forfeited and Sponsor reserves the right to select an alternate winner from among remaining eligible entries.
h. Sponsor reserves the right, in its sole discretion, to terminate the Contest without awarding prizes if no eligible winner or alternate winners claim the prizes within the required time.
i. Sponsor reserves the right, in its sole discretion, without prior notice and at any time, to cancel, terminate or suspend this Contest, or any portion thereof, should virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor corrupt or impair the administration, integrity or security of the Contest (including but not limited to attempts to hack into or otherwise tamper with underlying source code/programming of the Website).
j. Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the Contest, violates these Official Rules or otherwise engages in fraudulent or offensive conduct with respect to this Promotion. Caution: Any attempt to deliberately damage any website or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such Promotion Participants to the fullest extent of the law.
k. Name of manufacturers are used for purposes of prize description only and such use is not intended to suggest or imply the manufacturers’ sponsorship, endorsement, or the approval of Wüsthof for this Promotion.
6. DMCA: Sponsor complies with the provisions of the Digital Millennium Copyright Act (DMCA). In compliance with the DMCA, a Designated Agent has been established with proper documentation sent to the US Copyright Office. If you have a concern regarding the use of copyrighted material on any web site, please contact the agent designated to respond to reports alleging copyright infringement. The designated agent for Sponsor to receive notification of claimed infringement under Title II of the DMCA is Katherine Lauderdale, Senior Vice President & General Counsel.
The DMCA specifies that all infringement claims must be in writing (either electronic mail or paper letter) and must include the following:
a. A physical or electronic signature of the copyright holder or a person authorized to act on his or her behalf;
b. A description of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
c. A description of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit the service provider to locate the material;
d. Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and, if available, an electronic mail address;
e. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
f. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
7. Request for Names of Prize Winners and Official Rules: For the names of the Grand Prize Winner, Contest Winners, and/or Official Rules, send a self-addressed stamped envelope to PBS Food Healthy Recipe Contest c/o Ashley Carufel, 2100 Crystal Drive, Arlington, VA 22202. All requests for a copy of the Official Rules and the names of prize winners must be made by January 29, 2012. Please note on the front left- hand corner of your outer envelope whether you are requesting “Official Rules” or the name of the “Prize Winners.” Vermont residents may omit return postage if requesting a set of Official Rules.
