The Family and Medical Leave Act:
A Summary
- Effective since 1993
- Applies to state, local, and federal governments, including public schools
- Applies to private firms with 50 or more employees
- Covers employees who have worked at a firm for at least a year
- Allows employees to take 12 weeks of unpaid leave if they are unable to work because of a serious health condition
- Allows employees to take 12 weeks of unpaid leave to care for a newborn child, a newly adopted child, or an immediate family member with a serious health condition
- Requires employer to restore employees that return from leave to their orginal jobs or equivalent jobs
