Deregulation

West Virginia passed legislation in 2000 to deregulate its power industry beginning in January 2001. But the plan's implementation requires passage of related tax-law legislation. This has been delayed in light of the price spikes seen elsewhere in the country and West Virginia's current low rates. The state's deregulation plan is therefore on hold pending further evaluation. The restructuring plan had called for capped rates until 2004 and required utilities to transfer generation facilities to a fully separate subsidiary by 2005.
