Closing Commission Submits Report Amid Legal Wrangling
The commission appointed to make base closing recommendations
to President Bush submitted its report to the White House Thursday
amid continued legal disputes between the Pentagon and state governments
over the proposed closing of Air National Guard bases and units.
Separate federal appeals courts Thursday and Friday ruled in favor
of the federal government, which has met resistance from state
governments over attempts to close or alter National Guard facilities.

A federal judge issued an order Tuesday barring the independent
base closing commission from forwarding its recommendations to
the president due to a fight over the proposed transfer of A-10
aircraft (pictured right) from a Connecticut Air National Guard
facility.

two major blows Friday as the base closing commission voted to
keep open two bases that officials wanted to shutter and a federal

down a Pennsylvania Air National Guard unit without the governor's
approval.

Commission Overrules Pentagon on Several Key Bases
The commission charged with making military base closing recommendations
to President Bush overruled the Pentagon Wednesday by voting to
keep open several large Army and Navy facilities. The Base Realignment
and Closure commission may continue to meet until Saturday to
finalize its list.

Dept. Backs Pentagon in Plan to Shut Down Air Guard Bases
The Defense Department Friday received the backing of the Justice
department for its plan to close down a number of Air National
Guard bases over the objections of Air Guard commanders and state
officials. The Justice department, which also represents the Defense
Department in legal disputes over the closings, issued an opinion
that said Pentagon officials do not have to obtain the approval
of state governors before closing down Air National Guard facilities.
