Crossing the line at the border

In partnership with the Investigative Fund of the Nation Institute, Need to Know investigates whether U.S. border agents have been using excessive force in an effort to curb illegal immigration. Eight people have been killed along the border in the past two years. One man died a short time after being beaten and tased, an event recorded by two eyewitnesses whose video is the centerpiece of the report. Both eyewitnesses say the man offered little or no resistance. One told Need to Know that she felt like she watched someone being “murdered,” and the San Diego coroner’s office classified the death as a “homicide.”

The report raises questions about accountability. Because border agents are part of the Department of Homeland Security, they are not subjected to the same public scrutiny as police officers who use their weapons. It also questions whether, in the rush to secure the border, agents are being adequately trained. And it raises the question: why aren’t these cases being prosecuted?

Seems like they do indeed screen police candidates for  maximum aggression and bully propensities – the most racist & reactionary get hired.

Tell the border jumpers to stop crossing the line! Don’t put your self in harms ways and you won’t get run over!

  • tesseractyl

it is one thing to be run over accidentally by a motorist when you “put yourself in harm’s way” by crossing the street when you shouldn’t have, and another to have that motorist speed up and repeatedly run you over to teach you a lesson about jaywalking– isn’t it?

whether you agree or disagree with the individual decision to cross the border (a decision that will be difficult for you to understand if you are not willing to consider the many complex situations that lead a person to make that choice), i think it should be pretty clear for you to understand that the brutality that these border patrol officers show to an unarmed man screaming for help on the ground deserves at best some investigation and accountability– at worse it is inexcusable abuse of power.

Unfortunately, America is fast becoming the land of animal behavior. Where is the civility in these border officers? They are a disgrace to any department, border patrol or not, this type of abusive behavior shows how cannibalistic these ugly humans can be. Most of them really should be incarcerated for such ugly and grotesque behavior. Thank God I’m not related to any of them. I’d be extremely embarrassed.

So before we cast our comments we should know all the facts…..the media seems to show them as the innocent illegal remember the word is illegal….they are illegally crossing the borders and these Border Patrol men and women put their lives  everyday and every minute on the line to protect us from illegal drugs entering our country….so we should Thank them and not be extremely embarrassed by them…..God Protect All Of Them!!

This is saddening news, I tend to criticize the law enforcement of my native country and think twice of visiting, when the law enforcement of the country that raised me commits such a crime, this brings shame to this country :( No one has the right to decide over another beings life. This preview was 2 cruel to watch, I hope all of these officers that have shamed this country are brought to justice and may God forgive such an inhumane act.

  • As

This is a tragedy and those agents need and should face criminal charges. I am appalled at our agents behavior. I don’t care how many agents have been shot or killed, they are supposed to be and act according to laws. They are not meant to be a mob or executioners. This indefensible and anyone saying otherwise is not representative of Americans.

  • Bluemoon78

Its horrifying to know that these agents are being trained to kill. These are people not criminals, even so they have rights, they are first of all human beings. Very sad that this is all of the sudden a topic that has people angry, they are now picking on the weakest and that’s not only wrong but evil.

  • trueblue

Inhumane treatment is wrong regardless of who, when, and where.  The illegal immigrants know the risk and still take it.  This seems to be a neverending circle of abuse.  It’s time America deals with the immigration problem and finds a reasonable solution to allow illegals to become legal if there is no criminal history.

  • KZat

Of course there needs to be border control.  However, it doesn’t need to be policed by men who dishonored their badges to become murderous thugs.  Also, the US sent guns to the cartels, helping them turn those cities into war zones, not to mention the fact that the US is the world’s largest consumer of illegal narcotics.  We have directly helped create the problems in MX.  The drug war is an abysmal failure.  Also, since when have Americans become so hardened to others seeking opportunity here.  We need a compassionate and logical immigration policy reform.

  • Roy

As I look at the video, I see 10 officers showing restraint, containing the situation.  The officer used the tazer (minium force) in lieu of “hands on” where the officer(s) could have been injured.  Their actions followed the “use of force continuum”.  Homicide is routinly put on death certificates when the individual dies of other than natural causes.  The contributing factor here, was a combative indivdual on meth.

Tasers have their risks, but then so do the alternatives. It’s not intended as a tool of deadly force but rather as a way to avoid physical confrontations between suspects and law enforcement. Was using one inappropriate in this situation? It’s worthy of review. Perhaps with so many officers present, overwhelming the man physically might have been better strategy. It’s good to determine best practices and then train officers in those practices so that the inevitable emotions of the moment doesn’t drive the situation where it need not go. I didn’t see the beating being alleged in the video.

Is Need to Know asserting that their isn’t any process of scrutiny of these deaths within the Border Patrol? That would surprise me.

By the way, we can’t stop illegal immigration at the border as long as the rewards for being in the country illegally remain. To a great degree, the culpability of border deaths can be laid at the feet of those who opposed ending those rewards.

  • http://profile.yahoo.com/GFSMW3LBCBM6SSIW2VKBO53EYI The Brat Prince

so anyone that evades border patrol or overstays a visa that has no known criminal history can stay? that’s a dumb idea. it just encourages people to hop the border by any means necessary and may lead to violence if they are confronted if they think they can escape because of the reward.

  • http://profile.yahoo.com/GFSMW3LBCBM6SSIW2VKBO53EYI The Brat Prince

The “victim” of a nonviolent act like shoplifting is a corporation.  We’re talking about taking the life of another human being.  I’m sure you don’t actually think that killing is excusable just because the victim has broken a law.

This example of Border Police is clearly a horrible example of the DRUG WAR and ILLEGAL IMMIGRATION.

THIS DOCUMENTARY IS COMPLETED ONE SIDED. Was there any mention of the DRUG WAR or ILLEGAL IMMIGRATION??? You think that might piss-off some of them seeing it day after day?

I am not excusing the BP! What they did is a disgrace!

But what about all the decent USA Patrol Officers, Agents, and everday citizens of both countries that are being killed in the crossfire due to the DRUG WAR? Where is that MINOR DETAIL part of this Expose’? It’s not an Expose’ it’s an Advocacy piece. Ask yourselves, why would so many cops be acting so badly? They are at the breaking point and are frustrated. We’re all losing.

What are the protagonists views about the Drug War and Illegal Immigration?? What is Obama doing about the violent escalations along the USA Border? According to this video, too little, too late.

Obama BUYING VOTES by letting _Illegals_ in Free or stay – for a vote for him.
That’s Blind Self Interest for him, and for the people that are gullible or want something for nothing.

The Cops were wrong. The Drug War is a big part of this (he had Meth in his system!). And ILLEGAL Immigration is also a big factor.

    It’s not just the Cops!!

  • Mike from Massachusetts

  • Furnitureseller8

What kind of human beings descend by the dozen to pummel and torture to death one prostrate man with his hands cuffed behind his back?

What is wrong with this country? Post-9/11  Bush and Cheney really changed it from the land of the free, the bastion of fairness, truth and justice to a seeping sore of corruptions, cruelty and exploitation of the people by the servants of the people.
There is a terrible, frightening basic flaw in America today where officers of the people don’t serve the people who pay their wages, but instead treat them like slaves and the people let it happen because they’ve been told they’re being protected. Wake up America!
Although a powerful, unchallenged layer of  corrupt, unaccountable bullies exists in law enforcement and associated fields all round the country, the history of this particular Border Control points to the need for serious investigation and right now.Having noted details about the number of people killed by Border patrol in this story it seems highly possible that US taxpayers are funding the vicious hijinks of a bunch of sadistic, murderous thugs and their administrators are allowing or enabling it. Every officer in this disgraceful episode should be suspended without pay while an investigation takes place. The officer who administered the fifth, “punishment” taser should be suspended, charged with murder and made to face the legal system in front of a judge who will step out of the old boys network to make a righteous judgement of the facts. The officers whose report is the basis for the press release should all be fired. Every one of the officers beating that poor guy should be fired. And the Justice Department and the Border Patrol should be investigated and heads should roll. Thank goodness for digital photography, or the lies told by officials in this story would go unchallenged. And thank you to those who fought to bring this story to public notice. You are heroes.

  • Furnitureseller8

You, Sir, must need glasses. Ten officers do not need a taser to restrain a horribly beaten man lying face down on the ground with his hands cuffed. If they do, they are incompetent and should immediately be fired.

  • Mike from Massachusetts

Come on. Was he “combative” while he was face down and was handcuffed while they continued tazing him?

I didn’t hear them say “stop resisting” or we will Taze you again, or anything to that effect.Aren’t they supposed to give verbal commands? I don’t agree with the Documentaries’ point of view (blaming only the cops when they themselves and many others are getting killed everyday). I only heard them saying the victim was pleading “Help”. Maybe they can tell us if the Cops gave any verbal commands to “Stop Resisting”. I wouldn’t count on exculpatory information from the Documentary Producers  though. They have a point of view that blames everything on the Border Patrol without ever mentioning the Big Picture of Drug War and ILLEGAL immigration.

  • Mike from Massachusetts

“ I don’t care how many agents have been shot or killed,”
Really? Maybe that’s why the cops are so angry. They are in fact frustrated by our laws, or lack of them being enforced. It would be a shame if people came away, as the Producers intended, and only got mad at the cops, but to ignore Illegal drugs and illegal immigration as the core problem.

  • tjjsfishin

this is america……………..get used to it………………………

  • Furnitureseller8

And what was the weather like? They didn’t include that either.
Holy cow, the program was not about drug wars, it was about the inexcusable murder committed by ten clearly-NOT-decent border patrol officers. Maybe the decent ones were back at the base.

  • Julogue1

Tazers need to be re-evaluated.  The results of tazing cannot be predicted and too often lead to punishment (torture) and execution before trial.  This also happens within US borders to suspects who are legal.

  • Anonymous

The only reason we don’t have a legit guest worker program is the right wing racist wing of the country.  By the way, illegal immigration has gone down something like ten fold since the late 90′s.  It’s OVER.  These folks are naturalized Americans.  Learn to live with your brother, seriously

I am so upset and disgusted with Homeland Security after your program on the undocumented Mexican who was murdered by border guards,  This is an absolute disgrace and is very probably directly related to the gentleman’s statement earlier that he wanted to file a complaint against the border guard for kicking his ankle which had screws in it from an earlier injury. Anyone who cares about whether our border guards are murderers should write to Attorney General Eric Holder or whomever they believe will seek accountability for this outrage.  I am so angry that it is difficult to write this without using profanity.  It is an absolute disgrace. Thank you for shedding light on this.  People of good will must press forward for accountability.

  • Anonymous

In that savage group, I didn’t notice anyone calling for restraint, so each and everyone involved needs to be fired. Fired first, and then investigated and prosecuted in court. Unless there is prosecution, it means we accept this behavior.  This is public record, thank you PBS. Now, if our justice system doesn’t follow through, we have no justice system. Who ever tries to cover it up needs to be fired. I am so sick of USA Police State.

  • Donegal

Did you notice more than a dozen border agents surrounding the guy?  Then tasing him repeatedly?

  • Donegal

Are you psychotic?  Did you see the numer of border agents surrounding the guy?  Did you hear the witnesses say he was cuffed?  Did you see the number of times he was tased? Ten officers showing restraint?  Are you completely nuts?

  • Anonymous

Tazer was sold as being useful when officer’s lives are in danger, not when someone is unarmed, on the ground, facedown and handcuffed. Not when there are 10 to 1, and with that number, physical restraint would have worked. Taszer was used as torture, not as restraint and not to protect officers from danger.
It is your mentality – an authoritarian, violent perspective which damages and divides this country.

  • Anonymous

Didn’t realize there would be people sympathetic to the officers! It doesn’t matter if someone is here illegally, these officers clearly are outside the law themselves. I say if someone has 5 (likely hungry) kids and comes here for honest work, is he really that much different than you, if you were in the same situation? Which is the worst crime? This man-trying to make a living, vs a gang of officers beating a man for no reason.

NAFTA killed many small Mexican farms, and they end up crossing border illegally to work on our huge truck farms-basically, indentured servants. Mexicans are also victims to manufacturing moving from Mexico to China.

  • Compassion

Sounds like you think crossing the border illegally deserves a good beating while handcuffed and lying prone on the ground. Sounds like you think a person deserves the death penalty after being tortured at the hands of “officers” exempt from any law.  Makes me wonder about you…how did you learn to harbor so much hate? How did you learn to see another human being as being so different from yourself?  God help you!

  • Compassion

I am in complete agreement with you, Donegal! I’m so outraged and saddened that it will be several hours before I sleep. How can anyone treat another human being as this poor father of 5 was treated? What kind of life did the hazer (and the entire gang of “officers” who participated) have that made them so hateful?  Is this still the United States of America…a country of laws that apply to everyone?  Thank you for the suggestion to write to the Attorney General. I’ll do that, and I hope millions of us do!

  • Compassion

Por996,  your question seems to imply that illegal immigrant deaths are justifiable because border patrol officers were killed. THIS murdered illegal immigrant wasn’t resisting, wasn’t endangering anyone. He was brought to the border to be extradited. That’s all that should have happened.  The officers should just do their job, not torture and kill.

  • Anonymous

As usual, our “liberal” AG is too busy busting marijuana clinics and whistleblowers. Where is the outrage at this brutal, sadistic murder?

  • Provicia3Cholo

I have little pity for the man.  Hernandez-Rojas was a prior offender, a known drug addict (at the time of this incident he was, in fact, under the influence of methamphetamine), and his drug use caused both his combativeness and a weakened heart.  He was Tased because he was being combative (while being released to go back across the line, I might add) and his heart, weakened by effects of his addiction, stopped beating when he was Tased.  He has no one to blame but himself for the results of his actions that night.  Though it was tragic, had he A) not illegally entered the country, B) not weakened his heart through drug use, C) weakened his state and presence of mind through illicit drug use, and D) become combative with BPAs whom were doing their jobs protecting this country (they are law enforcement, not law makers), Hernandez-Rojas likely would not be dead right now.

It’s time we, as a society, stop looking for scapegoats and accept accountability where it’s due.

  • Xonia_01

Abusive behavior against Hispanic foreigners is wide spread in these departments. For the most part, it goes unnoticed, until someone video tapes the actual events and has the courage to bring it to light. Many of these foreigners take the beatings and assume they can’t do anything because the officers are the law. They dont realize that they are victims and that there are laws that protect them as human individuals. So sad.

  • Donegal

I wonder why “law enforcement” took the video from the tourists who happened to tape the incident.  One woman did manage to keep her recorded video, but the border police took the video of another couple.  Why would they do that?  Were the border police afraid they would get in trouble for beating and tazing a man to death?  Were they afraid they couldn’t handle the scrutiny of an investigation?  And  why would the border guards take him to the border alone, after dark, when the usual practice was to take deportees to the deportation point in a group?  I wonder if it was because Mr. Hernandez Rojas threatened to report an officer for earlier abuse?  Couldn’t that have been it?  Isn’t it likely that the whole bunch of them took one man to the border and gave him a lesson he didn’t live to learn?  Did you watch the program Provicia3cholo?  Are you familiar with the term “excessive force”?

  • Pumas1967elyhab

bastardos no hay justicia son unos aseninos con permiso

  • Anne

Did you even watch the video?  There were at least ten officers around him, he was handcuffed, and he was begging for mercy.  Tell me what you saw that led you to believe that he was combative at the time he was being beaten.

  • Cymbasays1

I am shocked to have seen this story about the killing of Hernandez-Rojas. I am so outraged that we have not been able to get the formal attention something like this needs through the basic law providing systems in the U.S. I hope to God you guys keep pushing for an investigation into the entire dept. of Boarder Patrol Officers and the Dept. of Justice. I hope that the broadcast of this show tonight will raise the level of awareness so something is finally done. I am so fing outraged that I can understand getting voilent against these officers. The other thing is when someone is being abused like her was, it is natural to have some type of defensiveness going on inside onself so they can protect themselves because I am sure shortly into this episode, Hernandez Rojas knew he was being treated in a manner which was not narmal. The fact that the same officer was driving him to this drop off point looks as if they planned to try and teach him a lesson. They are cowards these fucking cops who have the law to protect them in a way that they can be violent which I believe many officers are naturally voilent and getting a job like this allows them to express this violence whenever they can. I hope they get fired, put in jail and I hope that the US Justice dept or the US Border patrol offiice is found guilty of murder and not managing their dept. properly. The family needs justice and awarded millions of dollars which won’t bring their son back but maybe enough money will help them do something nice for themselves and their coommunity in general. Thank you to the last eye witness the young woman with her video. It is obvious that he was not resisting and when someone is handcuffed and on the ground face down, there is nothing more they need to do. Now, what do you do if you can’t get him into a car, well, he tried to keep from going in to the car  because I am sure he was afraid of being taken somewhere else where he might be abused even more. The more I envision what I saw the more I hope these cops, all of them who were there, are found guilty. I am not violent but I saw myself wanting to see these vops killed. I don’t know what is politically correct when writing in this format as I never do this but this show really got to me. Thank you for your willingness to pursue this further and I hope you are able to get this to go to court and all officers end up being named in this matter and they are all put in jail.

Americans have been turned into murderers by the Federal Government on the guise of fighting terrorism. This happened in Iraq many times, repeated many times in Afghanistan, and now at the border with Mexico.

These guys are criminals and need to be stopped by any means necessary. It is shame that humans are treated like this because of their place of birth. Which of these murderers made a plan to be born in the USA. Birth is an accident, a cosmic mishap.

    America stinks!

American law enforcement have turned nothing but bullies and thugs !  But its to be expected by a police state as they are brainwashed into thinking that it them against us. You get an uneducated person with self esteem problems, which most cops are, and you have a prime enforcer of the police state ideals. This is a case in point !!!

You dont beat and tas a guy to death like this. This guy is human with family and a future just like us. Unfortunately several guards think they have the right to kill in any situation Disgusting !!

  • RM

It was mentioned in the program on 4.20.12 that for many Americans, this incident was not such a big problem because illegal aliens are aggressively invading America. If they get shot or tased it’s part of the risk. It would be interesting to know more about the cases, if the illegals were criminals, etc. If you throw rocks at the border patrol agents just like the Palestinians do, don’t cry if you get shot. Remember many of these illegal aliens come to America to drink and drive with no license and no insurance, they commit hit-and-runs on Americans and get away with it, they steal American IDs, they take advantage of taxpayer benefits, get free health care at our hospitals, fill our jails, etc. So I say, if you invade our country, you might get your just reward.

  • Rick Norlund

RM, I’ve been in a fight with neighbors for years bullying me, using their kids to bully me, they have thrown rocks at me, I’ve video taped one such event, threw rocks at me and hit my car, and stopped and picked-up some more and threw them at me, the sheriff would not even investigate, did I have the right to murder these white kids? With a name like Norlund, you might guess, I’m white.

Cymbasalys1, One does not have to be educated to be outraged by this murder., and comment I proabably have 17 years of education and I usually type my responses in MS Word to make as intelligible a comment as possible, and paste it in, I didn’t do that here. I can tell you where a senative person sees something like this, this video of these cops murdering this guy, I shake at times I’m so angry, like now I see that I’ve misspelled sensitive, though all my years of education has not really made me a better speller. I usually type, re-read, re-read again and re-read again. It’s called editing, even then I find mistakes later. Uneducated people SPEEK UP (just misspelled sepak, speak, finally got it right)!
    Sincerely, Rick Norlund

The biggest democracy of the world…
12 policemen to kill a poor man desperately crying!

  • Rick Norlund

RM, didn’t you hear Ashley say that they (the Border Patrol Officers) were confiscating cell phones and erasing content (pictures or video) of the murder (a criminal act in itself, destroying evidence), do you believe these other cops when they say kids were throwing rocks(?) I had video and the sheriff would not investigate. I mean, REALLY!

  • Rick Norlund

Hitler was democratically elected! It took little longer than a year for Germany to become the worst dictatorship in recorded history! The Russia before WWII and the USSR after may have been worse, but it was not a democracy.

RM, just read your entire post, you and Americans like you are the

    espouse!

    It would
seem from the program that these cops admitted to the SDPD that Anastasio Rojas
was handcuffed, if this is true, then they (SFPD) now know that the press release
saying he was un-handcuffed and then became combative is false (probably and
intentional cover-up, another crime), the SDPD needs to re-question these cops
and do the right thing. The press release mentioned in the show was either (if
the border patrol officers did admit Anastasio was handcuffed) 1) the result of
the patrol officers lies to their supervisors, in that event they need to be
fired for the lies and prosecuted for murder, 2) if the press release was a known
lie by the agency, then the agency needs to be investigated for the cover-up.

Amen!  It appears that some people have EDD, Empathy Deficit Disorder.

Actually, the program did address the issue of agent deaths and safety.  A retired Border Patrol official tried to excuse the killing by claiming that BP agents are often attacked and that he “went to too many funerals” when he was Commissioner of Customs and BP .  NTK checked the facts and found that an Associated Press investigation had revealed that the dangers are grossly overblown, that BP agents are assaulted at a “dramatically lower” rate than ordinary police officers, and typically with rocks, not deadly force.

The illegal immigration issue was also brought up, in an interview with an activist, and was rightly batted down as irrelevant.  Human rights are human rights.

Perhaps you should have viewed the program before commenting on it.

  • Anonymous

LOUIE320, we never hear about BP agents being gunned down, because it virtually never happens.  Had you watched the show, you would have learned that the Associated Press studied the matter and found that BP work is “dramatically” safer than regular police work.

Stop changing the subject – there’s simply NO excuse for torturing and murdering a man who poses no threat.  I hope every agent involved gets life in prison.  What an absolute outrage!

  • Richard Genz

Thanks for your excellent investigation into despicable behavior by US government employees.  Thanks for the bravery of the young lady who kept on walking and was moved to speak up.

I’m writing to the President to protest  Hope others will do the same.

One major reason that people cross the border illegally is that U.S. businesses, individual citizens, and legal residents will hire them–either blatantly or under the table.  Until the U.S. government quickly severely fines and seizes the assets of those U.S. businesses and individual citizens–and deports the legal residents–who hire illegal entrants, illegal entries will continue.

  • Rand Y

Thank God for the border patrol! Half of Mexico would be in our country if it wasn’t for these agents. The mass majority of citizens do not want these ILLEGALS in our country. Stay in Mexico and commit your crimes down there. I just love how this one sided report says the poor LLEGAL was shoplifting only to get his anchor baby wife a bottle of Tequila and steaks for her birthday. I wonder how many other times he shoplifted and never got caught. These people are as low as a human being can get. They never followed the laws in Mexico or here. All this can be blamed on our federal leaders like Obama who pander to these criminals by refusing to enforce our laws. Obama even sues states trying to combat the invasion. All of the ILLEGALS should be shot on sight!

  • Mart

You clearly don’t remember or perhaps don’t register in your brain much of what you see and hear.  The program CLEARLY showed that he was NOT CLEARLY under the influence of drugs.  I doubt that many seeing this program would see a person who was combative.  I thought they did a good job a showing a person being criminally assaulted by a group of thugs.

  • Beto_dinero13

hahaha ” All of the ILLEGALS should be shot on sight!” its okay its not your fault people are not born with hate i blame your shitty parents !

  • roadhog9

Very one sided report. Just another innocent “migrant” worker trying to make a living for his family.Coroners report listed an ”Acute” level of methamphetamine in Rojas’ system at the time of death. Meth user. And really? Rojas was arrested for shoplifting in the U.S. and this program wants you to feel sorry for Rojas because he stole those items to give to his wife as a mothers day gift? Sounds like a thief. Lets examine the real facts; Rojas was in the U.S. illegally, commits a theft while under the influence of methamphetamine. Rojas is agitated, uncooperative and eventually becomes combative with agents. Confrontation ensues, has to be tased, physically restrained and ultimately dies. More questions than answers. What happened when the agents removed Rojas’ cuffs and told him to walk through the gate? Did Rojas refuse? Was he told he would be re-arrested if he didn’t proceed through the gate? At some point after Rojas’ handcuffs were removed, a confrontation occurred with the agents. What actions caused the agents to have to re-engage Rojas and put handcuffs back on him? Did Rojas attempt to assault one of the agents? We dont have the answers yet but we do know Rojas was under the influence of methamphetmine. People under the influence of meth do not think or act rationally. It is not uncommon for officers to continue to restrain a resisting or combative person on the ground once he or she has been placed in handcuffs. The video doesn’t provide any conclusive evidence that Rojas was being beaten by agents.

  • Rick Norlund

    roadhog9,
did you see the same program that I did? Do you give no credence to the eyewitness
accounts? Why did the BP take cell phones from witnesses and erase content, destroy evidence? There are other
    witnesses, PLEASE COME FORWARD!

  • Herman

Even if he refused before the cameras started rolling, he had clearly submitted during the entire duration of the video clip. What ensued was a group of angry thugs beating a foreigner to death because they could. All you are saying is giving reasons why these thugs were angry. Our society does not need gangs of anger-prone thugs armed with guns, tasters, batons and handcuffs unleashing their power on people, in this case an unarmed and handcuffed person. I do not believe this could be considered as “standard procedure”. The law was broken by those whom we have trusted to protect it. Why do you keep making excuses for them?

  • Jlvassos

Where do we write? Obama will be needing the hispanic vote soon, and considering there are more hispanics in the US then some of the racist idiots who are posting comments without thinking, Im sure he’ll listen. Yes he was here illegally, Yes he got caught stealing. That is no excuse for these officers to do what they did. First illegals then US Citizens

  • Herman

I am not arguing over whether he had or had not committed a crime days before, and yes he had small amounts of amphetamine on board. The point is, this is the exact situation where the rule of law is necessary: when there is a conflict. If we, and law enforcement, do not adhere to the law, then every conflict no matter how minor or serious can be justification for use of lethal force, and people will just start killing each other on the streets. Everyone will give a stupid excuse as to why they were provoked and killed someone else. Were the officers acting in self defense? What is the specific reason that in your mind makes their actions justifiable?

  • Jlvassos

Rand Y, go have your white hood pressed, you RACIST idiot. must be a result of inbreeding!!!

  • Herman

You can watch it online. It wasn’t on my local TV schedule either. Some channels might be afraid to air it because it may make them seem unappreciative of law enforcement, but it is available on line. Look up “Crossing the Line”

He was a lucky person not only did he invade the U.S once but twice in all rights he should of been shot. Now you wish to come here more power of you wish to do ot ths wrong way by invading, any other country did this (Russia) it would be an act of WAR.
SO WHEN DO GROW A SET. Bring home our boys (all of them) put them on the borders an and start protecting the home…

  • Gstoneiv4

Bo who…..how much could you all take someone coming into your house living in your basement then you find him you kick him out and then you catch him goong threw the window and then times that by 2~3million invading your home dont think he would of got of as easy as did, you have to start to back up your own country , the border patrol has to look at all of them come over and then get nailed for coming over and NOTHING happens to them other than sent home scary if I or any other citizen broke the law would we get told bad bad boy dont do it again now go home NO MATTER HOW MANY TIMES I DID IT…. No my butt would be sitting in jail for a time if not life after so many times of doing it….NOOOOOOOO! I am not saying to put them in jail so the citizens that are not braking the law or trying to envade somewhere that they are not wanted to pay for them to get more of a free ride, throw they’re buts in to the jail in they’re home let them pay for them, they’re home not that great have problems to d€m bad let them do something about just as my kin did. Let them fight for they’re rights if they want them dont come here and STILL MINE….STAY HOME … OR come here the right way do it the right way why would we/I want you here if you can’t do it ths right way dont brake our laws right of the bat by invading us and then want all the rights we have fought for because you do not deserve them…

  • Herman

Gstone, I bet you didn’t fight for any of our rights, and you don’t seem to really care about the most basic human rights, since you are used to the Russian way. Remember, this is not Russia, this is America. We’re better than what you think. If you want to bring your Russian thug mentality here and use Russia as an example of how this country should be, then you are the one invading.

  • Herman

Russia may be protecting its borders, but I’m not sure if they’re protecting anything else within those borders. Throwing journalists out of 19th floor, is that your next suggestion?

so sorry forgot to put Russia in quotation marks what was getting at is IF IT WAS RUSSIA INVADING US AS THE MEXICANS ARE, IT WOULD BE AN ACT OF WAR and WE (Americans) then would finally do something about it. Now Herman with the hint of not being BORN HERE, and NO no me but you understand if they wish to come here MORE POWER TO THEM ,BUT if they wish to do it the way most of you all wish to there would be alot more that would not dare to if there was a price to pay. I sit BAck and watch so many of the Mexicans not speaking ENGLISH and just about everyone I see in the line at the store using a food stamp card paying for food and the same steaks that I have and pay for it with my cash and then have to think about having to pay taxs thay is paying for those food stamps.
AND IN NO WAY HAVE NOW OR EVER SAID OR COMPARED THIS GREAT NATION TO RUSSIA BUT was a mistake for not putting the makes in the right place but then again I am on a small phone and large fingers.

Do you think illegal immigrants should be shackled, beaten and tased to death while screaming for help, as was the case for Anastasio Rojas, the subject of this Need To Know piece? Your comment does not seem to address the actual incident. The issue is not whether illegal immigants break our law: it’s about the fact that more than a dozen border patrol agents brutalized and killed a man who was handcuffed and whose legs were tied together. Even worse, the agents who committed this brutal killing have not been held accountable for their actions.

I’m just now re-watching Crossing the line at the border,
it opens with a press release from the SDPD saying the Rojas was un-handcuffed
and combative, “IF” Border Patrol agents admitted to SDPD that Rojas was
handcuffed, then you will not get satisfaction from the SDPD because they
themselves are part of the criminal cover-up. Now that video is available
showing that the SDPD (apparently) was lying in the press release, they need to
    be investigated also.

    Rick Norlund

  • Rick Norlund

Re-watching the show, handcuffed and hog-tied, is apparently, what BPAs reported to the SDPD, thereafter the SFPD made, an apparently, criminal cover-up of Rojas’ murder, for the Border Patrol.

    Rick Norlund

  • Rick Norlund

    I’d
encourage the Rojas family to make the SDPD part of the civil lawsuit, as, if
nothing else, co-conspirators in the cover-up of the murder, and as complicit
in hiding evidence, you can bet that they will fight tooth and nail during discovery, I jost hope that the Rojas family gets a good judge.

So right Herman and I’ll add, what is the difference when a Cuban manages to land his feet somewhere on American soil?  He is granted entrance into the United States.   Is the Cuban escaping to better himself and is the Mexican trying to better himself.  Killing people is not what our Law-Enforcement agencies are supposed to do.  I received a pin because I supported Border Patrol Agents that I believe were wrongly accused of a crime and imprisoned but I cannot condone what I see and hear in this video.  Even if this victim was originally combative, he was killed when he was subdued.    We have seen other abuses involved with Tasers and it is time action is taken to stop the murder of the poor and unfortunate never the wealthy and elite.

no one, whether a United States of America citizen who has done nothing  wrong , or a person who is NOT a USA citizen who has broken the law, deserves to be beaten, tased, and killed in an arrest, especially when not offering resistance, and for a suspected crime that is non-violent and non-lethal.  i am ashamed of the USA enforcement staff who acted in this way, and of the management who trained them and allowed (or, perhaps encouraged) this action.  this is what tyrrancial dictator ships with no civil rights allow and sometimes encourage, and is NOT part of the values of the USA.

I watched the video today, and I was horrified! If this new evidence does not prompt the government to order a full arms-length investigation, then that sends the message to all Americans that the border patrol agents are above the law! That will spell the downfall of our human rights- and justice-based institutions, and the U.S. will decline into lawlessness that would be characteristic of a third-world country.

The super-altruists in here don’t care if illegal alien criminals invade America, drink and drive with no insurance and no license, kill and maim people in hit-and-run accidents, fill our jails, commit many crimes, take advantage of our social services, close hospitals by overwhelming them with debt because they don’t pay a cent, etc. etc. When an alky illlegal alien kills your loved one I will be thinking of you. ha ha  Did this illegal alien have a criminal history? Let me know . . .

  • asdasdasd

Nobody deserves to be beaten and killed like that, regardless of their drug use, history of petty crime, or immigration status. I presume that you are fortunate enough to be a U.S. citizen and that you will never have to imagine why someone would want to risk life, limb, and liberty, to get work. I pity you.

  • Gennyc

Oh yeah us citizens never drink and drive or do hit and runs or drive without insurance. Try and find something else to say because that was bs.

  • Darlene Loucks

OK he is illegal, he is a criminal. Criminals who are U.S. citizens should and do not get treated this way. This criminal should also not be treated this way.  Mexico should help the U.S. in our defense of prosecuting illegals and bear the cost of returning the aliens back to their country. This persons family needs to be deported also. No one needs to be tortured or killed in response to their criminal activity except in the case a person trying to enforce the law and their life is in danger by that criminal. There should be a federal investigation into these deaths. The U.S. federal government needs to relook into our laws and constitution and enforce the laws as humanly as possible.

  • Arthur Eaton

The problem is the Department of Homeland Security, which should never have been created and which will ultimately be the destroyer of all our civil rights and the human rights of anyone who dares oppose it.  The Border Patrol did pretty well before being co-opted into this organization which has no accountability to Congress, the judiciary, or the American people.  People should remember Benjamin Franklin’s remark that “Those who are willing to sacrifice essential liberty for the promise of a little temporary security deserve neither.”  (And will lose both.)  Wake up, Americans!

  • Arthur Eaton

Invade?  I don’t recall seeing anything about him having a weapon.  “Should have been shot?”  Remind me never to come to your town – you might shoot me for “invading” it.  Does “grow a set” mean beating and killing a handcuffed, defenseless man?  I’ll keep my own set, thank you.  We can defend our borders without such wanton brutality.  We did that pretty well before the Department of Homeland Security stuck its finger in the pie by co-opting the Border Patrol.

There is a petition that can be signed to protest this homicidal outrage. I agree that they all need to be fired, after due process. Those who participated by joining the physical assault should be tried for manslaughter. Those who seized the cell phones of those bystanders who captured it on video should be tried for concealing evidence. If those involved gave false evidence to DHS or DOJ investigators, they should be tried for perjury as well.

It is sickening to see the anti-American reporters and their backers crying about the tasing of an illegal alien who was resisting arrest, or the Trayvon Martin incident. I want to hear Americans protesting the black woman who killed a white woman in cold blood after stealing her baby. Or is that ok because she is not white? I have a feeling the comments in here come from offspring of illegal aliens or otherwise anti-American foreigners. Oh yes, and also the brain-dead crybaby liberals who wish they were brown or black. Try chemical pigmentation.

More terrible news about the policing in this country! There is no justification for this! No rationalization will cover this for any reason! Why is the US becoming a 3rd world country? Privatization of Immigration Detention Centers and Immigration “laws” are making  US look like 3rd world country!

Hey! I have an idea about your post….why don’t you actually watch the show “Need to Know?” That way, your question may be answered.

  • Anonymous

You know, if you would talk about the white victim, instead of engaging in a racially-based, um, paranoid bitterness, maybe attention would be turned that way, too.
Seriously, if folks with badges would straighten up and fly right, and folks like you would stop the hysterical spewing about people of color all the time, perhaps there would be some attention paid to other issues. Like that poor “white” lady and her stolen baby upi refer to..

  • Anonymous

Yeah…and all white men sit in their Lazy Boys in front of their trailer homes, with a cur on a chain, swillin’ Pabst on the one hand, strokin’ their shotguns with their free hand, lookin to protect Americans from the invader  ”illegals.”

Forums full of third-world descendents, America haters, white haters. I guess I can’t expect anything different in our new America, an America that has allowed decades of rampant illegal immigration from countries that hate us. Our politicians are to blame, they are all corrupt, greedy, and concerned only with their own prosperity. Let’s all watch as our country descends into third-world status.

  • Gkmeinert

For eight years I’ve been on the Citizen’s advisory board of the Nogales Station of the Border Patrol.  I’ve photographed and documented the whole Tucson Sector from the New Mexico State line to the Yuma County line.  This is the epicenter of illegal activities in this country.  I know what I’m talking about that this article is pure unadulterated trash!  The agents are continually held to a high standard and training never stops.  Last year of a total of 21,444 BP Agents nationwide and approximately 20,000 Customs agents there were only 16 found to have committed a crime against border crosser or any other crime such as aiding smugglers.  I printed this article out and will use it to its fullest benefit…..lining a bird cage.   Gary Meinert

  • whitewave31

Only sixteen “found” to have committed a crime against a border crosser? How many agents were beating that man in the eyewitness video? And even though they’ve been literally found on video using excessive force, they haven’t officially been “found” committing a crime by the Department of Justice—AND THAT’S EXACTLY THE PROBLEM.

  • whitewave31

WOW. You are so right. The man killed by border patrol agents in the video hated white people and America so much that he got himself tazered and murdered on purpose just to make this whole country look bad. Jeez…

  • whitewave31

I agree with you and appreciate your compassion. I just have to say that his family doesn’t necessarily need to be deported. Immigration law is much more complicated than we usually think. His children might be citizens. (I know some people think children of immigrants shouldn’t get citizenship, but that is not the way the law works.) A lot of times we think of “legal” and “illegal,” but we don’t have any words for people whose statuses are in between and who have to stay in the country while their statuses are adjusted.

Agree with you. But NOONE is seeing the bigger picture here yes he did shoplift and no w his crime goes into account and add up for how much shops have to rasie they’re prices to make a profit, but the Very first thing he did was crossed illegally and not only that but also has wife and kids here ad as have said in other parts on this program that in crossing illegally him and wife are really invading the U.S.A . And if it was any other country that did this they would not of even got 30 feet into this land with out dieing so what is it that makes them so speacial to not only live after doing it bit get the chance to do it and then comment a crime and then get sent back home to do it again and again like all the other ones have done now as far as what the did not really the best way of doing it but realize jow many ppl the have had to take back to the boarder kist to watch them walk from one side of the border (ours to they’res))and start to try comeing back come on ppl this would be very agervating to Me also, do my job to just sit back and moone cares or gives the respect to stay where you have been put and dont come back that way again do it the right way do the paper work. Now granted they did go alittle over board with the beating him they should not only threw him in Mexican prison but went and retrieved the wife that had the balls to go on TV and bowho about hubby and let the goverment know she was illegal and know nothing was going to be done about it and thrown her in the prison right with him …… AND AS FAR AS JIMBO1672 IF YOU THINK BEING A BORDER PORTAL IS SO EASY AND SAFE YOU NEED TO WATCH THE PROGRAM BORDER PATROL WHERE THEY’RE GETTING SHOT FROM ACROSS THE RIVER AND GETTING SHOT AND KILLED……

Nothing good as always….

  • Gstoneiv4

How are the to do that when the start out breaking the law right from the time they get here……..ILLEGAL

  • Gstoneiv4

How is it you think they are not criminals?????this dods not make sence being an ILLEGAL IS A CRIME SO THEY ARE CRIMINALS….

  • Farmers_son64

Only 16 crimes I wonder what kinda crimes they committed it must have been something like sleeping with a prostitute because that’s the only thing people seem to get up set about. If you can look at that video and say it’s not murder you have a real warped sense of morality. Murder is murder no matter who does it badge or no badge. This human being was hand cuffed and hog tied and 15 men I should say cowards  conspired to kill him pure and simple. The only difference between them and BTK (Bind torture kill) is well I can’t think of any thing that makes them different. This is sick disgusting and immoral. In my state they would be sitting on death row and that’s where they need to be. It makes me wonder how many people are buried out in the Texas Arizona sands. And it’s not just the murder they covered this up by erasing peoples videos. If they were convinced they had committed a crime then why try and hide the evidence?

  • Gstoneiv4

Ther is a criminal history on all that are here illegally…. ILLEGAL is a crime and how long has it been going on? To long

  • Farmers_son64

I hate to tell you this but it happens to US citizens every day also.

  • http://www.facebook.com/sharon.tipton Sharon Tipton

Border Angels bring water to migrants crossing the border. Minutemen roam the desert near there to take the water. This has caused hundreds or thousands of deaths. The racism of U.S.  reveals the hateful thinking of anti-immigrants.

  • Bahona78

To say that a person is an “illegal alien” does not mean that they are in any way a criminal. They are “illegal” because they are trying to support their family.  Same staus as a 17-year old who works the graveyard shift while attending high school, who would be breaking the law by violating curfew.  There is absolutely no evidence that either of them would therefore kill people in hit-and-run accidents.  So, you would support ther death penalty for a high school student who gets a job to help support their family?

  • Rick Norlund

Maybe we should put all criminals in jail, if you speed
you are a criminal, do you deserve to die for it(?) or go to jail for it? Crossing the boarder is not a capital offense, though you’d have it be one, without any due process, shoot on sight is your motto.

    Rick Norlund

  • Rick Norlund

Looks like I stepped into a forum where my comments are not appreciated. ha ha  The editors don’t want any opposition, that’s usually the way it is. Ok, I will not return. I agree, let’s just open up America’s borders to the rest of the world. No more guns (or tasers). No more wars. We are all brothers. Can’t we all just get along? Peace and love. Taliban we love you.

  • Jim Byrnes

I missed “Need to Know” on Friday but saw the Video: Crossing the line at the border this morning

on Democracy Now!.  It made me sick at heart and sick to my stomach.
It reinforces my growing belief that our government is little more than
a cover for organized crime replete with torture and death squads.
What “Justice” department ignores the kind of behavior shown so graphically on these videos?  And who hires these thugs and goons, anyway, who masquerade as law enforcement.  They are scum and should be prosecuted for torture and murder.

  • Sam

We’re not asking for the borders to be opened, you idiot. We are just asking that people not commit murder and acts of terror. Indifference to evil is worse than evil itself.

  • Viveros

The murder of a human being can not be justified by arguments of “protection” We have to go back to the issue of what makes people want to migrate to the US. The US crosses borders for their own benefit in many different forms that reflect their politics based on acts of violence and power. Institutional and phisical violence. The issues and murders in the border all one part of a whole system that operates to subjugate mostly people of color in and outside the US.

  • Elsa

It is important that people focus on the issue in this case. There was a man HANDCUFFED on the ground who was tased five times until he died. He had three fractured ribs and bruising throughout his body from the beating by Border Agents. None of the Agents involved were injured, except one agent who was struck by a baton as another Agent attempted to strike Mr. Hernandez-Rojas as he laid on the ground. I have talked to many of my friends who work in law enforcement and everyone has told me that they have never heard of a time when it was ok to tase a person who was handcuffed on the ground. These are the facts. They are not exaggerated and come directly from the public record. The two videos speak for themselves. Unless I missed something Mr. Hernandez-Rojas is not seen ever resisting nor fighting. If I am wrong someone please show me on the two videos where he struck someone. Finally, what would we be thinking if one of our citizens was in a foreign country and this happened.

  • jeanie

Every citizen with any sense of justice should demand that this man’s family be compensated and taken care of for the rest of their lives for the incredible injustice and murder of their husband and father.  The “problem” of our border needs to be handled with commmon sense and compassion, both of which were lacking in this and other senseless incidents.

  • Accountable4MyActions

These officers removed a soul from the planet, and left a mother to fend for 5 children on her own. (Democracynow.org) WHEN will they be held accountable? The people who shot this video have not been contacted by Homeland Security, there is no investigation. The men who MURDERED this man may be at work today! CBP.gov says, Report suspicious Activity to 1 800 BE ALERT. Give them a call, it is suspicious to have 20 some officers treating anyone in this manner. Or give the main San Diego office contact a shout.. Chief Patrol Agent: Paul A Beeson, Deputy Chief Patrol Agent Rodney S. Scott. Contact information Phone (619) 216 4000. Well I’ve wrote every news agency and government official I can think of. The only response I have gotten back is from CNN. I guess if it had been a blonde haired blue eyed girl that had this happen to them it would be all over the news. The only thing I can think of is that there scared to say anything. It seems the patriot act has done it’s job. Does anyone remember when the press wasn’t afraid to do there job.  How I miss Walter Cronkite never afraid to tell the truth. Good job PBS for having the courage to show this murder on national television. Let this be a warning to the rest of us you maybe next.

I saw the video on I think i just witnessed a murder I’m a so appauled at the system those cops should be stripped from their jobs Mr Rojas was the victim here…. What a disgrace all those cops there and not 1 cared enough to do the right thing, they are all guilty even those who just stood there and watched this helpless men get beaten by so called cops. it is obvious how angry and hostle they cops really are…… i am angry and tearfull horrified with the border patrol and the justice system too. Years later you don’t have enough evidence to convict every cop that was there? what a joke the video is plenty evidence of the brutality Mr Rojas suffered

  • Farmers_son64

I can see that the interest in this murder is waning. The number of post has really dropped off. Shame on us. Don’t let this go. Call or write everyone you can think of keep up the pressure. Nothing will get done until the elections are over but we must not forget.

  • Freedom Union

This is so awful and especially hits home as I’ve worked with the people that have made it over.  These people are running across the border for HOPE.  To have Patrol backed by a badge beat and murder a man for trying to run for a better life is beyond absurd.  We have had two little boats crossing at night from Mexico loaded with murderer’s and drug smuggling that if one were to need physical attention I’d say they should be pushed around.  This is a problem of MEXICO to treat their special hard working people of whom leave their families behind to get out of poverty.  FIRE THE FREAKS THAT BEAT.  My heart goes out to the family of this man that was a runner for HOPE.

  • Ebb

This is terrible to see.  The law is law – that’s fine: cuff ‘em, serve your required penalties but don’t beat someone that’s on the ground and tazer them against their will.  There should be penalties for *THAT* as well!

  • alarmed

we need to be concerned about this behavior…these are people who abuse their authority. if they can do it to one group they can/will do it to anyone.

  • Farmers_son64

And they do abuse there powers every day no not all but even a good officer will turn his back when he see’s other officers engaged in bad behavior. Don’t think for one second you won’t get your brains beat in for just asking the wrong question or being in the wrong place at the wrong time. You really have no rights when it comes to law enforcement.

First, why after fifteen years in the U.S. can Maria Puga not speak English?  So much for the myth of assimilation.  Second,  it is a paradox that while the U.S. Justice Department is hounding Sheriff Joe it may be committing far worse injustices.  Finally, the stonewalling relating to the killing of Hernandez-Rojas is reflective of the secrecy that is creeping into the federal government at all levels.  National security is being used as the canard to strangle open government, and the  American public seems to be content either out of laziness or fear to go along with it.   1984 is here.

When in panic mode and while under great duress and pain, most people speak in their native language.  The germans knew this during  WWII and used it to find spies.  He is also is surrounded by people who speak Spanish and he is most likely crying out to those people.

  • Joheneldritchson

In all accounts, not all of those were Border Patrol Agents.  Some people need to take a look and notice that most of the FEDs standing there are Port Officers that work at the port.  Notice the uniforms.  This is either the second or third instance when the Border Patrol as been blamed entirely for a situation dealing with an individual being tasered at a Port of Entry when it was actually a Port Officer using the taser.  Just clearing up some of the mud being slung at the wrong people.

My family has been in America since 1648.  I view illegal immigration as a huge National problem.  I am a former Navy Aviator, who trained, lived, and worked in San Diego for years.
To watch an unarmed, handcuffed, “hogtied” man be beaten to the point of death by our Border Patrol makes me ashamed to be an American.
No cop in America has the right to be judge and jury.
All who participated are felons and deserve long prison sentences, huge fines, and forfeiture of all pay, pensions, and benefits.
Or are we just another third-world country where the rule of law is only talk?

I am watching the need to know about immigration. so far it is a love fest. where is the discussion of ethnic tension between hindis chinese russians arabs and other immigrants of other countries. so far everybody is staying in there own neighborhoods. but as the new immigrant population increases what steps are being taken to have a peaceful transition. I have heard stories about professional from India treating other people from India of a lower caste they way they did in their country of origin. That republican White woman who claims harassment from racial profiling is talking about the immigration populations of 50 years ago. How do those immigrants feel about the new ones? How are immigrants treating the people they meet here now?
Maybe the question is how do we get young immigrants that dont need social services(minors and 50+) to live here, people like that can live any where.

Oh and by the way, there was a second picture of a dead baby pictured as a sleeping arab child. Since you are on before a lot of children have gone to bed, talking about casualties (of’course they won’t ask what a casualty is) and showing a deceptively sleeping baby is just as disgusting as the sentimental photo of the dead baby from africa.
You exchanged a staff of people who were professionally equal, but a different color; for the same type of people right on down to a different color baby.
SHAME ON YOU NEED TO KNOW
I need to know that I won’t see dead babies because it is not poetic. I need to know that a real controversial subject will not be massaged.

me, born and raised in USA. I went to more than one other country out of USA to see how other cultures live. I tried to legally bring a partner into the USA to be my spouse more than once I was denied. Me, being the blue collar worker I am the government has robbed me of my rights in USA to import a spouse and to have my own business, any person in USA has to have lots of money to move forward in any way in the USA.

Do not forget…these illegal immigrants are breaking the law to begin with..if they didn’t try to enter the country illegally to begin with…they would not have this problem. I am sick of all the illegal  immigrants and drugs flooding our country…I bet the border guards are threatened everyday they do their job by these illegals. Don’t get me wrong, any border guard that abuses anyone breaking the law is wrong and should be investigated…but I am tired of illegals…do it the lawful way or just stay out.

There are at least six (6) Immigration Judges in San Diego and I have seen first hand how each Judge goes out of his/her way to show compassion for an undocumented person in deportation proceedings. Indeed, throughout the proceedings, the Court repeteadly emphasizes this Country’s values and demands utmost respect for those departing. The Court’s reasoning is that these foreigners will see and tell of America as a fair, humane, and just country. An America that even while enforcing its laws, still affords anyone basic human treatment and respect. These criminals undo all of those efforts. They do not represent this Country well and certainly bring shame to the thousands of officers who serve and protect our borders from terrorists and organized criminals.

  • Jcp

sam wong, your lack of compassion for human suffering shows what kind of human being you are. It saddens me that you have chosen to brown-nose to the racists anti-hispanic thugs in this country. does it make you feel safer, in a gang-mentality kind-of-way, to close ranks with their ilk?
You seem to share their ignorance, as well. Don’t you understand that if it was possible for them to come in legally, they would do so. Do you know how long is the waiting list to immigrate legally for an average Mexican, or Central American, if they do not have an immediate relative here, a degree from a US certified university in medicine, nursing, science, english, or a million dollars in cash?? The waiting list might as well be 100 years. They might not qualify for any visa, at all. If there is an immigration expert here who might answer this question, please jump in. In any case, they have no choice but to try anyway they can to earn a living. 100 years ago, if you were northern European, all you needed was a boat ticket and be of good mental health. It is not that easy anymore. Today they have quotas on visas. Only so many visas are available to each country. So for people in some countries, the waiting list is longer than those from other countries. Some people know this, and use other countries as stepping stones to get here. This is just regular immigration visas. You also have  refugee visas. But not everybody is trying to escape a communist, or other reppresive,  regime, or a war. In short, is far easier for a farmer, or herder, from Somalia, or Pakistan, to immigrate legally, than a college graduate from Mexico.
Can’t you picture yourself, or your relative, in the victims shoes?? Is there any empathy in your soul?
Can’t you picture that if China, not Mexico, was next door, all these undocummented immigrants would be Chinese? Don’t you know that, may be not anymore, there were scores of Chinese coming through Mexico to enter the US illegally?
Don’t you know that a reason of why Mexicans still need to enter the US illegally is because the hundreds of thousands of manufacturing jobs that they expected with NAFTA never materialized? That that was because all those jobs were suction-off to China without any laboral, human rights, environmental conditions  at the request of the US giant retailers, like Waltmart, and US manufacturers who could not count on cheap labor in the US anymore since the authorities got tough on hiring undocumented workers, here???  That this has created a monster that is generating un-employiment in developing countries were China sends commercial spies to copy local products and dumping their cheaply produced copies??? Can’t you understand that we live in a global community and that what you do in one place has consequences elsewhere?
Why don’t you come to your senses and stop scapegotting hispanics before the gang of thugs, you are brown-nosing to, turns on you???

  • Harry Jack Spiers

Gloria, please let some compassion into your heart, and then you won’t be showing your ignorance so much.  Prejudice can’t be masked with a cold smug reference to “law.”

  • esl

another question to ask is were any of those border patrol officers HIspanic?
a major adjustment would be to mirror the immigration laws of Mexico and the laws of the top 5 countries for US immigration. If they think it’s right to treat U.S. immigrants with no basic respect and hostility for wanting to live in their country with their pensions or as aide workers; then the governments of these countries would have little to say about how badly their citizens are doing. They would know what to expect and make adjustment. The ball would be in their court.

  • esl

Ralph Noyes, its nice that u claim the native Americans who lived here before all of us. may I remind u to claim what your European immigrants ancestors did both physically+mentally to the natives of this country. Immigration without a smart growth vision of the future something like Ellis Island and angle Island on the west coast, will make many people suffer.

“Immigrants accounted for more than 45 percent of the growth in Colorado’s population in the past two years.

“California has practically doubled in population in the last 35 years. 96% of its growth in the 1990′s was due to immigration. California now has 35 million, and is larger than most countries of the world.”

Many cities in california are either facing or filing bankruptcy!

Chicago: a city that can’t even take care of it’s own citizens poverty and inequities  Mayor Rahm Emanual, declares Chicago a sanctuary city for all illegal immigrants and they all can now receive any and all welfare benifits, food stamps, health care, education. How long will it take for Chicago to to become bankrupt??

can the US afford to continue to invite poverty?
can the US afford to continue to promote welfare?

  • Grrrrrr

The officers involved should be prosecuted to the fullest extent of the law.
This is a direct result of our government “looking the other way”. The same goes when an illegal alien thats been apprehended but not deported kills someone. Defenders on both sides jjustify. They say it’s such a small percent? Not the norm but just the unintended consequences. Our spineless federal Government and Lawmakers are really the guilty here for making it sort of ok to be here illegally, sort of ok to break our immigration laws but not really and the mexican government for not taking care of it’s own citizens and promoting illegal entry th the US.
    This is very sad.

  • Roy

You seem to think that you’re entitled to immigrate to America,
that we owe it to you…Let me tell you…We don’t owe you a thing. You aren’t
entitled to come here just because you want to. It doesn’t matter how long the
waiting list is! America has fought for her borders and spilled her blood doing
so. She has earned the right to choose who should be allowed on her soil. Do you
think we should just have a free for all and bring in the entire world if they
want to come? How many is enough? We can’t do it anymore, it’s unsustainable.
Since 1990 congress has allowed more than a million immigrants per year. 4x
higher than the traditional level. This does not count all those who are here
and coming here illegally and their babies. In 1996 even Clinton strongly urged
congress for big reductions on immigration numbers in order to allow the
population to stabilize but they didn’t listen and if we keep up with these
immigration levels the census suggests by 2040 our population will be at 400 million
and 625 million by the end of the century.
How do you think the overcrowding will affect
the already strained economy, resources and demands on the infrastructure, our national
lands and quality of life? I’m sure there are many good people who need a chance,
but we can’t even give our own impoverished a “better life” right now and we
owe it to them first and we owe it to ourselves before we can take in the rest
of the world. People are just going to have to find a way to get their
governments to take care of their own. It’s not always our responsibility.

The officers involved should be prosecuted to the fullest extent of the law. If the story has merit.

The answer is not to condone breaking the law whether it be mistreatment of ILLEGAL immigrants or breaking into our country without our permission. I am extremely tired of  you guys pulling out the race card. WHAT PART OF ILLEGAL DON’T YOU UNDERSTAND.

I was outraged by the treatment of these people by America’s Border Patrol Agents!  I was even more outraged by the many insensitive comments of so many people!  It is beyond me how people seem to think that just because someone is an illegal immigrant that somehow they are not human.  It amazes me to think that so many Americans have the attitude that these people deserve to be tortured or killed for coming here, what ignorance!  And it angered me to see the Border Patrol Agents, that take an oath to not cause harm, seem to think it is funny to empty out jugs of water so as to make these people suffer.  These are the same people think that these illegal immigrants come to the U.S. for the hell of it.  Really?  These people come here as a last resort the majority of the time.  They don’t want to really leave their families, their homes, and everything they know.  Many come to be able to make a little bit of money feed/support their families.  Many are not even aware of what they will encounter, racism, hate, death, torture, being demeaned or taken advantage of, etc.  Some Americans should put themselves in the shoes of these people and has some compassion and treat these people with some dignity, you never know when you might be in a situation where you need help.

  • Ihrc

This is inhumanity. Pure and simple. I can not believe what my country is doing! I shake my head and I no longer want to call this my country. I no longer want to defend my country’s reputation to the criticisms of others from the international community. I feel the rage and sadness from such events as above, replace the desire to love my own country.

We are speaking about a country, whose very foundations were built on principles of human rights, yet employs the violations of human rights and determines which lives are equal in value and which are not, in order to maintain the hedonism and apathy of its sheep within the borders.

What a surprise that another human being would sacrifice his or her own life to be with their family!? WOW!! And we stigmatize this person’s integrity to honor those binds of love as an “illegal immigrant” or “undocumented person”. Is their any religion in my country let alone common sense!? May we call “love” the pursuit of happiness or not!?

Let us state that for future reference, if an officer or officers of the law desire to seek retribution against you for any motive, laying on the ground and screaming help while in handcuffs can be construed as “combative behavior” and “justified homicide”. A lesson from our progenitors was that power corrupts. Is this not an example of unchecked power here where a human life can be extinguished for following that pursuit of love!? Of course, the mentally atrophied and socially stymied will say ALL immigrants are pursuing wealth instead. As if no one but they alone, the plaintiffs, are full of human qualities.

All I can say is that when you create a “city on the hill” with too many people living beneath suffering and their loved ones on that hill, expect others to want to be a part of it, it is called human nature. Perhaps we should study thoughts on human nature in our own origins and see if we were ever allowed to regulate or stop it? And to what extent?

My family’s sacrifices for this country during wars since 1711 are in vain. Since 9-11, we have turned illegal immigration from an economic problem into a potential terrorist threat. As a result, we have lost our own principles which founded our country. We have lost the ability to understand and resolve the problem practically. Worse, we have lost our own humanity!!

This injustice we see before us is a direct result of a modern Cotton Mather (George Bush) who has set us on a path in a War on Terror, declaring those who are outnumbered by heavily armed officers, drowned in their own screams and pleas for help by tazors while simultaneously claiming that the fact he was tazored and died was proof of his guilt. If he were killed by a drone, he would also be guilty. The unstated assumption, the acts of those in authority are beyond scrutiny and void of responsibility. Couldn’t we have just thrown this man in the river and declare him a witch if he drowned rather than do this to him and crush the dreams and hearts of his family? At least the same beast from the past could be more recognizable today!!

Absolute disgust and sadness what I have witnessed!!

       God forgive all of us.

       Siraj Davis

Regarding your  ”Crossing the Line” episode I’d like to make a couple of points. The Border Patrol is tasked with stopping hundreds of thousands of illegal immigrants a month. The folks who leave water out for them may mean well, but their sympathies are misplaced. There is a big difference in molesting a immigrant and in making a crude joke, which may have been meant to lighten the questioning process regarding pregnancy. You seem to find fault with the B.P. no matter what.
I would have preferred to see questioning of the Ambassador from Mexico as to why we have to deal with thousands of their citizens per month. The Mexican government should be limiting population growth if they do not have enough jobs for their citizens (as have the Chinese). They should also be supportative of living wages so their citizens can make a living in their own country.
It is no wonder the Border Patrol agents are overwhelmed by this.

I shake my head at the inhuman treatment of Brian Terry’s family and still no answers for his family.  Holder clams up and Obama exerts executive orders to seal all information.  This whole illegal issue is a disaster and getting worse all the time.  We are flooded with these people and when our agents try to stop the sieve, they’re called to task.  It’s a war down there, plain and simple.  These people want respect coming here illegally, then stay home where they belong.  We have enough of our own problems without taking on all of Mexico’s as well.

I just got back from crossing the in El Paso, Texas. I was with my family which included my husband, my two children (ages 4 & 3). They asked us a string of questions and I suppose my explinations weren’t satisfactory. They then processed to ask me to pull my car over where they asked more questions and wanted all of us to step out of the car. They unleashed their drug dog on my car and on my entire family including my children. mind you my son is three years old and as severe asthma. After they finished unleashing their dog on us to their dismay guess what they found…..NOTHING!!!!!!! Absolutely nothing. They put six guys on my car and my family as if they were going to find something. During their little escapade one officer remained by me and continued to spit on the ground right next to me and when they allowed us to be released the same officer sarcastically waved at me as we drove away from the site. Neither my husband nor I have any prior criminal history. My children and I are proud United States citizens and husband is a legal permanent resident of the United States, so please CBP tell me why my family and I were treated like criminals when no drugs or illegal aliens were found in our car/possession. Thank you CPB, taking down NONCRIMALS one at a time. You guys deserve an applause…..NOT!!!!!.

I live in the SouthWest of Texas and I used to hang out with some border patrols agents and I can tell you that the mayority of them do not have a bachelors degree, they do not have a supervisor to tell them what to do, and have  a relative easy job. In fact, the only requisites to be a border patrol are:
    1. To be a U.S. citizen
    2. Have a high school diploma or GED
    3. Pass the physical training.

In one ocassion one agent told me “I like this job because nobody(supervisor) is checking me and I decided how much I work”. So I can say this is not an overwhelmed position and if it’s not the case then these agents should not be working in a place like this. My mother is a Nurse and I believe is a more stressful job. In fact, the illegal immigration of Mexicans has decreased since 2002.

It is so sad that so many invaders are coming to our country, that we now have to use lethal force to protect our borders..  There are no illegal immigrants  they are invaders and should be treated as such  but with humanity in mind.

Which truths, exactly, were slanted? Entering the country is not a felony, btw, but in most cases a misdemeanor, and punishable by being returned to your country of origin. Entering after being removed is a felony, yet again punishable by being returned to your country of origin. As for the SDPD’s “investigation”, we now learn SDPD interviewed less than half the agents involved, and only for a brief amount of time. And, could you please specify the threat posed by someone who is handcuffed, hogtied and lying on the ground while surrounded by 15 armed officers? I’m curious.

  • John

How about people you need to come into your house, to clean it, fix it, paint it, or build it, who you employ for say, 10 years – because you either don’t want to pay others a higher wage, or more likely, no one else is willing to do the work for you? People, you’ve invited to work in your home, who pay US income taxes but will never get a dime back. What do you call them, each day as they enter your house to work for you, “Criminal?”

Prime example of our backwards society today casually handing over unwarranted power and authority to almost anybody, especially those who are untrained, don’t care about it and have no idea what to do with it. These are the same people who easily get taken over by their newly-given powers, develop a false sense of pride, and exert/abuse it whenever they have the chance (it’s all they have). It makes absolutely no sense that officers and police enforcement (might as well bring in the issue of underpaid teachers in the education system for that matter) are valued/usually paid so little, yet they have such enormous responsibilities and influence over our lives. We allow untrained and corrupt citizens to become officers who ‘ensure our safety’, we allow ignorant teachers who don’t give two sh*ts to teach/influence our vulnerable children and shape the rest of their lives, while celebrities and the entertainment industry are ‘valued’, and get paid ridiculously high salaries. Welcome to America.

  • zempath

We are all human and should treat each other humanely. The trouble is that most of the BP agents are not human and are not capable of being human. This is a common theme throughout the world. The psychopaths tend to congregate at places where they can do most abuse with least responsibility. They go to places of authority – government, police, border patrol, department of justice etc. No action from the authorities shows clearly who they really are — psychopaths. Stop appealing to them. Justice belongs in the hands of the just.

  • zempath

Therefore, torture and kill them? For economical reasons?

If the US can afford spending trillions on wars, the US can afford to take care of the poor. Go look how people live in India or Mexico and see who cannot afford what. Many Americans (may be, even that is probably not true) cannot afford an Iphone, the third world people cannot afford a piece of bread. American people are WAY too spoiled and bratty.

In fact, it is the poor countries that support the US. By providing the US with cheap labor and cheap products. It is a modern form of slavery. That’s the reason the US should share it’s wealth, just to quench that little bugging voice of conscience, if it still exists.

This is not the same Country I was born and raised in. This is not the same Country that I devoted half my life defending against all enemies, foreign AND domestic. This is not the same Country that I will die in; and thank God it will be sooner, rather than later. If this isn’t “clear and convincing” evidence that what was my Country has lost ALL of its moral integrity, than I don’t know what is.

Vigilante violence is not the answer. It’s our house; we need to clean it. We have a Constitution; we need to enforce it.

Oh give it up. You this is true. The Mexico president sends his illegal immigrants here on purpose. Along with there disease’s and whooping cough. Which 76% of all Hispanic people coming to the united states carry. Plus there children do not have and of the shots they need to provide immunity against M.M.R, EYE INFECTIONS OR FLU VACATIONS. But I guess this is what happens when the country your from is very poor. At least I’m my state. With no green card means. No house no bank loans, rentals health insurance doesn’t even matter is your pregnant. The Dr or Niece just sends ya to the free clinic to have it kids. or jobs. Which I think is awesome. Thats the only positive thing that Obama has done for this country!!!

Ray, 100% with your post. Our moral integrity is indeed questionable. This could be anyone’s son, brother or father. Father of three girls, taxpayer, USAF veteran, and deeply concerned about accountability in our country.
