Need to Know, April 20, 2012: Crossing the line

In partnership with the Investigative Fund of the Nation Institute, Need to Know investigates whether U.S. border patrol agents have been using excessive force in an effort to curb illegal immigration. Eight people have been killed along the border in the past two years.

One man died a short time after being beaten and tased, an event recorded by two eyewitnesses whose video is the centerpiece of the report. Both eyewitnesses say the man offered little or no resistance. One told Need to Know that she felt like she watched someone being “murdered,” and the San Diego coroner’s office classified the death as a “homicide.”

The report raises questions about accountability. Because border patrol agents are part of the Department of Homeland Security, they are not subjected to the same public scrutiny as police officers who use their weapons. It also questions whether, in the rush to secure the border, agents are being adequately trained. And it raises the question: why aren’t these cases being prosecuted?

    tviiolate our laws by trying to sneak in. If you are brave enough to try to sneak in and our caught, cooperate fully with border patrol or risk a beat down or worse.

    Do you know what happens when Central American and South American immigrants are detained in Mexico? No doubt this conduct is reprehensible but keep in mind that there have been only 7 or 8 “alleged” cases of abuse on the hands of Border Patrol agents. Yeah, out how many detentions? Hundreds of thousands!. Also, this guy was on meth as corroborated by the coroner. So, don’t make so much noise. Bottom line, this guy’s family wants money! that’s all. He knew the possibility of being harmed crossing the border illegally, specially when he crossed high on meth!

    As far as being on meth.. Was that of his own doing ? It’s common for smugglers to drug immigrants to make them keep moving. As far what Mexico does, who cares. We (the US) make demands for civil rights for all around the world, but yet we don’t practice what we preach. If you really do some research , you find more than 7/8 cases.

    Though I do not advocate illigal entry, I just think there is a better way. Maybe do away with NAFTA which practically killed the common farmer in Mexico that couldn’t compete with subsidized products flooding their market from the US and Canada. Instead of spending billions on border protection that doesn’t work (and BTW, the government allows most through to keep alot of agricutural businesses afloat) . Help rebuild there farming industry and make a “Fair Trade” agreement instead of “Free Trade”. If you really do your homework, you will find most do not want to be here, they want to be with there families just like us. They come out of a necessity. I know I would do whatever it took to provde for my family.

    I don’t condone excessive force in the death of this man Ilegally in the USA for 27 years.
    But, I don’t think it deserves outrage.

    Let me tell you about outrage.
    Here in our state, we have about 200,000 people Illegally here. They brought 38,000 of their offspring to our state, to sit in our K-12 class rooms at $8000 each for a cost to taxpayers about $300 Million a year ($300,000,000) every year. We have $250 Million wired to Mexico every year from our state, not to be circulated to get us out of this financial mess. Last year, Medicaid paid for 4800 births from women Illegally in the USA at the cost of the taxpayer. Once that ‘Anchor Baby, aka Birthright Baby, or 14th Amendment baby” is born, the door opens up to Food stamps, Medicaid, and other safety net programs we pay for. These people are paid under the table, they don’t pay taxes.

    Last year, we had a female police person killed, murdered, by an Illegal who had been deported 3 times, only to return to deal in Crystal Meth and Marijuana. He shot her, as she approached his car with an AK-47 in the neck. She died on the road. He tried to run back to Mexico but we caught him. We have robberies, hit and runs, and gangs with many Illegally here in our state. The cost of these non-USA invaders is killing our Public School System with the Babysitting of the Illegals.

    Many of the “Pro-amnesty” have married illegals, knowing that if their spouse are caught, they will be deported locked out of Legal Immigration for 10 years.

    If Need to Know wants to report, report how much these people are costing us. How they are affecting the other kids they sit in class with. These people need to go home. Using an incident for a 30 minute broadcast devoted to a man who was Illegally in this country and suing our law enforcement, is really irresponsible. I think that it is wrong what happened but needs not to be amplified.

    I think this is the second program devoted to Illegal Sympathy you have aired. That is enough.

    Do a program on how much these people are costing us as a nation, tangible and In-tangible and you might be doing the public a service.

    So this is what our country has become. Most of the comments disgust me as much if not more than the documentary itself. I wondered how this could happen, now I know. There are so many hate filled people in this country who do not care about other human beings. These are human beings trying to make a life for themselves and their families. How very, very sad for us.

    Why are you outraged at Need-to-Know for broadcasting a factual program for 30 minutes, and yet don’t think there should be outrage for the gang-murder of this person? Wouldn’t it be fair to say that the ill effects of illegal immigration are well known to all, and a report of a murder will not turn illegal immigration into an acceptable process? 

    The officers who were electrocuting this man were not doing it to save your schools, they were doing it out of the shear pleasure of killing a helpless person. This kind of behavior needs to be challenged by the good people of this country. Times are tough, and that is exactly when the danger of hate and oppression escalates. The schools and health care issues need to be dealt with by the legislature and not by 12 men in the dark of the night hiding behind their uniforms and serving hatred and violence instead of law and order.

    Jpalm, I agree with you.  I am outraged by the murder of this man who was clearly pleading for his life and not causing any type of physical harm to the dozen border agents who were surrounding him.  I am nauseated by the vitriolic racism and bigotry of the comments that have been posted, and am horrified by the number of people who are so blinded by their own racism that they have some how justified murder in their own twisted mind.  What kind of society do we live in where it’s necessary to remind people that no one is subhuman or not entitled to basic human rights just because they crossed a border without proper authorization?  I wish to remind everyone who has posted some sort of justification for the killing of Anastasio Rojas that the penalty for unauthorized presence in the U.S. is not death, and neither shoplifting nor drug usage are capital offenses.  Dig a little deeper to figure out why you’re not sickened by his murder.

But you can probably find another reason.I have not witnessed the scenario you are describing, and I doubt if you really have witnessed it as you describe either.     The really amazing thing about living in a democratic country with the rule of law is that we don’t punish people for the crimes of others – even if they happen to be members of the same gender, religion, race, or national origin!  So the crime of one Mexican is that person’s crime, just as George Zimmerman’s crime is his own, and not the crime of all white men in Florida.  Is it really so hard for you to admit that Mr. Rojas should not have been killed?

    There is a right time and a right place for making your statements, and another time and place for showing some respect and humanity. If cheating is what makes you angry then the murder of this illegal alien should also anger you because in committing this crime the border patrol was cheating. This was not what they get paid to do.

I question the validity of this story. Also to people passing this around, how many Border Patrol Agents, ICE Agents, INS Officers, and others did your Criminal Illegal Aliens Kill or mame last year? Personally I don’t think you care about that, do you? It’s always about these poor little people who are just trying to make a better life. You don’t even care about them breaking our Laws. What contributes to the hatred and collective action that we can see has “crossed the line” — to not only this man, his family, but others and our comon humanity.     This report is disturbing that illegals are getting murdered by border patrol agents when they are helpless and tied up unable to stop their abuse and killing. 18 of such kiillings  uninvestigated and  patrol agents. not investigated and punished is wrong. Such killings will only stop if the Justice Dept.
    investigates these cases. Patrol agents who lie about their actions that result in deaths of illegals must be prosecuted in a court of law by our Justice dept.

    We thank you for airing investigative programs like “Crossing the Line” (Need-to-Know, April 20, 2012), that shows the plight of Mexicans and Latino immigrants at the border. There is a lot that the majority of U.S. people ignored about the tragic issue of immigration, and that is why shows like Need-to-Know and Frontline are so important. U.S. people need to know what CAUSES people from Mexico and Central America to risk their lives trying to migrate. U.S. people need to know that most immigrants are decent hard-working family people that have been forced to migrate due to the U.S. foreign policies imposed on Mexico and other LatinAmerican countries such as the failed U.S. “war on drugs” and NAFTA.

    Welcome to the American Police State !  This kind of thing is happening al over the US and the govt does nothing. the media can eve get information about the Border Patrol policies on lethal force.     First, I do not agree with the excessive force used in this case. I also understand the frustration of border patrol agents who are trying to stop illegal entry into this country. I wonder if PBS has EVER done a program on illegals’ violent acts against citizens of this country?? To my knowledge, it never has. How about the Chandra Levy case–more than likely attacked violently attacked and then killed??  How about the young woman raped in Edmonds behind a store in 2010? Jose Lopez Madrigal had been deported 9 TIMES!! And then consider the illegal who shot a father and his two sons (Bonano was their last name). So it’s nice when you see only one side of a situation–to have fair coverage of a huge problem, let’s have both sides shown. Mr. Suarez, would you do such a story? I bet not.

HUGE respect for Natalie Young of Seattle for her courage in filming and coming forward. And apologies for the pain and heart break to Roja’s family. How can one have any pride in one’s country?

    I found this Need to Know episode extremely one-sided.  Of course what a few Border patrol agents did in this case was outrageous; this case should be investigated and the Border patrol agents at fault should be punished.  I don’t think that this one incident deserved nation-wide coverage.  Abusers unfortunately exist among the police, the military and prison personnel.  In my area of southern New England a man was recently stopped by police; he did not co-operate like the Latino subject of this piece, was pushed to the ground and beaten so severely that he died a few hours later in the hospital.  He was unarmed. And no, he was not black or Hispanic; he was white. I wonder why Need to Know doesn’t do a nation-wide piece on this person???  Incidents such as these happen fairly frequently when you look across the country.

    The fact is that there are 20,000 border patrol agents who arrest hundreds of thousands of illegal immigrants every year.  That there have been eight unnecessary killings over a several year period is unfortunate, but the per centage is almost 0.  In the meantime illegal immigrants have killed border patrol officers and citizens living along the border; why doesn’t Need to Know also air a piece on these incidents if they wish to show the scope of the whole problem?  And why don’t they air a piece showing the considerable social and economic stresses that the current tidal wave of illegal immigration is causing many communities.  This was a very one-sided piece; a piece of propaganda.

    to Pkreckovic and others that “complaint” about this report being “one sided” you are so WRONG!, The fact is that what really is one sided is the entire media in general that whenever a crime is indeed committed by an immigrant it becomes the top news 24/7 and it is overly-reported. That is why reports like “Crossing the Line” although rare, are necessary to show a sneak peak of the other side of the story. It doesn’t matter what the police report said or what his witnesses said, just watch the video.  Just watch the video.  Just watch the video.     As described by Chris Hedges, one of the most perceptive and illuminated journalists in the US, this country is in a state of “soft” fascism while changing laws to prepare it for an all out assault on individual liberties when the big financial and economic collapse finally arrives.
    If this treatment is already being applied to legal residents and citizens of USA, what can we expect for the police to do against undocumented workers?

    It is about time it is clearly understood the period of relative freedoms and attempts to form an egalitarian society are over…… at least if not enough people wake up to the sinking of this ship.

    - The victim was HANDCUFFED while being shocked and kicked, both eye witnesses declared.
    - The screams are not in anger but in pain and panic for his life.
    - The ONLY resistance was trying to avoid being put back into the car because he feared for his life, as the actual death probes him right.

    With all the rush to secure the borders why are we gently stepping over the real matter.  The matter is the question.  And the question would be, why are the people running from one land to another.  I’d say it’s because they wish for a better life, and decent living to support their families.  Is it possible our society or government is not handling this matter in a political way.  President to president speaking, pick up the phone and ask Mexico, hey your people are running onto our land due to lack of income.  Yet, we are buying produce from Mexico that treats large majority of their working class like old dried up cactus on side of road begging for glass of water.  CUT MEXICO TRADE OFF, AND REFUSE TO MARKET THEIR PRODUCE UNTIL THEY PAY HIGHER WAGES.  It sure would be nice if we could focus on the HOPE RUNNER’S and organize on MEXICO’S land the matter that truly needs to be handled.  This will go on for years, and think of all the families destroyed.  It makes me sick and even sicker we don’t slap Mexico on the hand in regards to this civil rights matter of humans seeking real wages, yet here they have ads about buying avocados from Mexico.  Puts my knickers in a bind, honestly.  Someone needs to empower these Runners to stand on their own land and demand for better rights.

As for the patrol;  If one is entitled to carry a set of handcuffs, badge of honor, gun with bullets and beats or murders the victim.  I could be three years old and tell you this is wrong.  This little wolf pack of badge holders have even more potential to sexually assault say a female runner or male.  They need to be removed from the force immediately and not paid a dime as well as lose their pensions.

    Excessive us of force is bad enough, but these criminals thinking they can then go around carrying a gun on their hip and start demanding that anyone with video delete any legally obtained evidence of a crime is absolutely the last straw. The US DHS either fries these guys and sets an example or its revolution time. If the government is going to protect and thereby allow a person or a group of people to commit a crime as heinous as murder and then go around and start forcing US citizens to detroy evidence of the murder, it is tyranny and not democracy that we have. This type of action is why I started this post citing the First Amendment. Under tyranny you have no rights unless they are convenient for the government to allow. What other instrument besides a revolution will sufficiently challenge the power of an entity that believes it is not to be held to account. And sorry, but this cloak and dagger behind the curtain “accountability” does not cut it.

    Any system of governance that seeks to justify its own existance must gain the trust of the people. It is the people that make it valid. What moral human being would hold a government that fails to openly condem this type of activity is worth making valid?

    Lock these criminals up and make public the mug shots. Give the citizens reasons to believe in its government and that it serves the people. I do not wish for a revolution, but if murder and the subsequent illegal cover up and violation of the constitution in the process is allowed, what choice does a society that desires to be self governed and free have?

    Thank you so much, PBS and John Carlos Frey, for this thorough and damning report. Thank you, eyewitnesses, for letting your conscience be your guide, and for coming forward. Thank you for getting the truth out.

    I am horrified by the unjustifiable, sickening brutality that Anastasio Hernandez-Rojas endured and that killed him. My heart bleeds for him, and for the family that grieves their father and husband. I am sick to death that US Border Patrol agents can sadistically beat an immigrant to death and enjoy total impunity. Moreover, this crime seems to have been premeditated: Anastasio Rojas was singled out for retaliation, because he wanted to file a complaint about the abuse he had already been been subject to while in Immigrant Detention. It is chilling that the very agent who repeatedly kicked his ankes at the detention center, was one of the pair who took him back to the border by cover of night, and exacted their revenge on a helpless man, handcuffed, hogtied, and on the ground. This is tantamount to a lynching.

     The Department of Homeland Security must identify all the Border Patrol agents who participated in the beating and tasing, who took part in this lynching, and/or failed to interrupt it. Officers who so abuse their power and commit a heinous murder cannot be allowed to continue to wear the uniform of the Border Patrol. Lawlessness in law enforcement cannot be abided. The Border Patrol must be seriously cleaned up.

    The Border Patrol agents who participated in the beating and tasing, who took part in this lynching, and/or failed to interrupt it must be indicted. The Department of Justice MUST investigate this murder. WE must not let them bury this. A public outcry resulted in the indictment of George Zimmerman for the murder of Trayvon Martin. Are we not capable of joining together to demand justice in this outrageous case?

    Just the fact that you use the word “sides” shows a bit of racism. Let me explain. This is a government agency against the people in this story, be it someone without legal documentation or not, he was in the USA for 25 years, living as a citizen… beat like a dog by people that are being paid under employment, hired. You ask for coverage on gang life or whatever you can grasp to say that employees of the government should be “forgiven” in some weird way because justifiably there were killings from the “other side” and that “other side” would in fact be Mexicans, right? If you want to talk “fair coverage” than why do we not talk for a moment about the entire immigration issue and what is “really” happening. Why not talk about the tens of thousands of children that have a parent deported, American children… where are their rights and why are their rights as children lower than what you consider to be your rights, or the ICE officer consider to be his rights…Why is that? Because “the other side” might gain points so we will just label those “types” of children “not real Americans” or unworthy of full American rights. What about the  well over 5 thousand American children that are put into foster homes and never even get to say goodbye to their parents that are deported without any effort to reunite them taken in government, or the best one yet being the babies and children that are put into jail cells so called detention centers, separated from their mothers at night even if they are sick and crying… not for one night but sometimes months or years… what about the American wives with American children who have to wait out the 10 yr,20 yr, lifetime bans with thousands in legal help or even live in exile in a country that people are fleeing from!!! Where are our rights to pull in our husbands, how does our American citizenship not award us our right to normalcy when we met our husbands as the boy next door!!!!! You want to talk “fair coverage” for “the other side” How about that? Let us do so, publically, and see what happens when people know a little bit about family unity on American soil.

How could the government take family unity so lightly?!

    Border patrol agents are the foot soldiers of the US and Mexican 1%.  The
    law of the land is to maintain their insidious and dysfunctional immigration, drug
    and economic policies.  This bi-national
    1%’s control both governments in order to increase their riches and maintain
    the status quo. 

    Their paid politicians and private run media paint the Mexican poor as
    criminals and terrorist invaders.  Their propaganda therefore justifies
    murders as above a necessary part of doing the business of “protecting
    America”. 

    I use to be a Border Patrol agent.  I know. 

    How else can you explain a democratic government using helicopters and border
    police to chase human beings down at night like animals?  

    Some of the people crossing the border and being chased are actual criminals
    and need to be caught. The majority of the people crossing are the people who
    pick our vegetables and do our menial labor.  Those vast majorities of
    these people are good family people and are not criminals nor are they
    animals. 

    They are simply pawns and scapegoats in the bi-national 1%’s profit game of delusion,
    control, and brainwashing the 99% on both sides of the fence. 

    In my mind the occupy movement knows no borders and stands against the unjust
    laws and practices of the worldwide 1%.
