{"id":3862,"date":"2013-03-14T10:26:57","date_gmt":"2013-03-14T17:26:57","guid":{"rendered":"https:\/\/www.pbs.org\/independentlens\/blog\/?p=3528"},"modified":"2023-08-02T12:46:34","modified_gmt":"2023-08-02T19:46:34","slug":"the-film-that-revolutionized-the-conversation-about-military-rape","status":"publish","type":"blog","link":"https:\/\/www.pbs.org\/independentlens\/blog\/the-film-that-revolutionized-the-conversation-about-military-rape\/","title":{"rendered":"The Film That Revolutionized the Discussion about Military Rape"},"content":{"rendered":"<p>Nominated for an <a href=\"http:\/\/www.newyorker.com\/online\/blogs\/closeread\/2013\/02\/the-invisible-war-can-a-film-about-rape-in-the-military-win-an-oscar.html\">Academy Award<\/a>,\u00a0<em>The Invisible War<\/em> (airing May 13)\u00a0has changed the way we talk about sexual assault in the military and even impacted policy. <a href=\"http:\/\/www.filmindependent.org\/resources\/case-studies\/case-study-the-invisible-war\/#.URFN0lrXlYg\" target=\"_blank\" rel=\"noopener\">After watching <em>The Invisible War<\/em><\/a>, Secretary of Defense Leon Panetta transferred the power to prosecute sexual assault from the level of <a href=\"http:\/\/atwar.blogs.nytimes.com\/2012\/04\/17\/panetta-proposes-new-sexual-assault-rules-for-the-military\/\">unit commander to colonel<\/a>.<\/p>\n<p>This Wednesday, three women and one man who were sexually assaulted in the military testified about their experiences before\u00a0the <a href=\"http:\/\/www.armed-services.senate.gov\/hearings\/event.cfm?eventid=e84164e57b3384ad52bbde4fcb4bc753\">Senate Armed Services Committee\u2019s Wednesday\u00a0hearing<\/a>. It is the first hearing on sexual assault in the military in a decade.<!--more--><\/p>\n<p>One of the veterans, former Army Sgt. Rebekah Havrilla, was raped by a fellow service member in Afghanistan. An Army chaplain told her it was \u201cGod\u2019s will\u201d that she was raped, <a href=\"http:\/\/abcnews.go.com\/blogs\/politics\/2013\/03\/military-sexual-assault-victims-testify-before-congress\/\">according to ABC News<\/a>. Later, her aggressor admitted to \u201cconsensual\u201d sex while he was married, but the military dropped the charges against him.<\/p>\n<p>\u201cThe military criminal justice system is broken,\u201d <a href=\"http:\/\/abcnews.go.com\/blogs\/politics\/2013\/03\/military-sexual-assault-victims-testify-before-congress\/\">Havrilla said<\/a>.<\/p>\n<p>Earlier this month, Panetta <a href=\"http:\/\/www.huffingtonpost.com\/2013\/03\/11\/air-force-sexual-assault-_n_2853738.html?ncid=edlinkusaolp00000003\">tied the issue of military rape<\/a> to the February shooting of two Santa Cruz officers. Jeremy Goulet was accused of two alleged rapes of military officers and ultimately accepted an \u201cother-than-honorable\u201d discharge. The two officers had been inspecting another sexual assault complaint on Feb. 26 when Goulet threw open his door and fatally shot them. \u201cHad Goulet been convicted of the two rapes, he probably would have landed in a military prison for life,\u201d <a href=\"http:\/\/www.mercurynews.com\/nation-world\/ci_22742944\/panetta-military-looked-other-way-case-jeremy-goulet?source=rss\">according to the <em>San Jose Mercury News<\/em><\/a>.<\/p>\n<p>Back in 2012, Panetta moved the power to prosecute sexual assault up the chain of command to colonels so that, in theory, they would serve as more impartial judges and <a href=\"http:\/\/atwar.blogs.nytimes.com\/2012\/04\/17\/panetta-proposes-new-sexual-assault-rules-for-the-military\/\">enact more prosecutions<\/a>. The policy change \u201cwas an important first step, but it\u2019s still in the chain of command,\u201d<em> The Invisible War<\/em>\u00a0<a href=\"http:\/\/beyondthebox.org\/women-soldiers-get-equal-footing-two-itvs-filmmakers-react\/\">director Kirby Dick told ITVS<\/a>. \u201cThere\u2019s a conflict of interest. The colonel may know still the perpetrator or may know the commander who knows the perpetrator, it\u2019s a direct connection, or the victim, either way. And it should be taken out of the chain of command.\u201d<\/p>\n<p>This week, one high-profile case moved all the way to the top of the Pentagon. Defense Secretary Chuck Hagel will review the case of a lieutenant colonel who was convicted of sexual assault and then dismissed of the charges an Air Force general. The dismissal <a href=\"http:\/\/www.npr.org\/blogs\/thetwo-way\/2013\/03\/12\/174098087\/generals-dismissal-of-sex-assault-conviction-sparks-anger-review-of-system\">appalled members of Congress<\/a>.<\/p>\n<p>Other recent policy changes have impacted the role of military women specifically (an estimated 20 percent of women and 1 percent of men in the military have been <a href=\"http:\/\/www.library.ca.gov\/crb\/12\/S-12-004.pdf\">affected by sexual assault<\/a>). In January, the Pentagon repealed a 1994 law that barred women from infantry roles, even though female soldiers have worked in the line of fire for decades and <a href=\"http:\/\/www.nytimes.com\/2011\/06\/22\/world\/asia\/22afghanistan.html?pagewanted=all\">more than 100<\/a> died in Iraq.<\/p>\n<p>\u201cCombat positions are seen as the pinnacle of military,\u201d Kirby Dick <a href=\"http:\/\/beyondthebox.org\/women-soldiers-get-equal-footing-two-itvs-filmmakers-react\/\">told ITVS<\/a>. Women \u201cwon\u2019t be quite as much second-class citizens. I think that will reduce harassment.\u201d<\/p>\n<p>In June, Kirby Dick and producer Amy Ziering held <a href=\"http:\/\/www.thewrap.com\/movies\/column-post\/military-rape-documentary-invisible-war-leads-policy-changes-its-opening-44671\">a screening for senators<\/a>, congresspeople, and their staff, including Barbara Boxer.
