Supreme Backing TVA was not without its detractors. Charging that the constitution did not allow the government to produce and sell TVA electricity as though it were a private corporation, Wendell Willkie, president of the Commonwealth and Southern utility holding company, took the lead in a series of lawsuits aimed at the New Deal's power programs. For five years the matter was fought in the courts. In an initial victory that shocked even its supporters, the Supreme Court ruled 8-1 in favor of TVA. More court victories ensued and TVA's legitimacy was secure.
