NOVA's "'What's This Stuff?' asks David Pogue" Contest

Think you know your stuff? Be the first entrant to identify 10 mystery materials from a set of clues and win a MacBook Air! The "What's This Stuff?" Contest runs from January 12 to January 26, 2011 and can be found during this period at http://pbs.org/nova/makingstuff.

The Contest is open to legal residents of the fifty United States and the District of Columbia, except Arizona, who, at the time of entry, are at least eighteen (18) years of age. The Grand Prize Winner will receive a MacBook Air, a $100 iTunes gift card, and the opportunity to hold a video chat with the Host of Making Stuff, David Pogue. Up to ten Runner-Up Winners will receive an iPod touch. See below for complete contest rules:

  • ELIGIBILITY: NO PURCHASE NECESSARY TO ENTER.

    The NOVA "'What's This Stuff?' asks David Pogue" Contest (the "Contest") is void where prohibited by law. The Contest is open to legal residents of the fifty United States and the District of Columbia, except Arizona, who, at the time of entry, are at least eighteen (18) years of age. By participating in the Contest, each entrant and each winner are hereby deemed to agree to these Official Rules and all eligibility requirements and guidelines of the ""What's This Stuff' asks David Pogue" Contest. The Contest is sponsored by the WGBH Educational Foundation, One Guest Street, Boston, MA 02135 ("WGBH"). The Contest is not open to employees, officers, directors, trustees, and members of their respective immediate families or households, of WGBH, the Public Broadcasting Service (PBS), PBS member television stations, or their respective affiliates, and subsidiaries. By entering, each entrant acknowledges compliance with these Official Rules. Each entrant must meet all eligibility requirements and guidelines for the Contest.

  • HOW TO ENTER:

    The Contest begins on January 12, 2011 at 12PM EST, and ends on January 26, 2011 at 12PM EST (the "Entry Period"). All entries must be received during the Entry Period. Entries received before or after the Entry Period and/or those entries that do not meet the guidelines, are not eligible. Incomplete or inaccurate entries are void.

    WGBH reserves the right to use any information submitted by entrants for any purpose whatsoever.

    The contest home page (the "Contest Home Page") may be accessed from a link during this period appearing on the following page within the NOVA Web site: http://pbs.org/nova/makingstuff. In order to enter the Contest, contestants are required to create an account via the Contest Home Page during the Entry Period. Contestants who do not create an account may still access the Contest's clues but will not be eligible to win prizes.

  • ENTRY CRITERIA:

    (a) The Contest challenges contestants to determine the identity of ten (10) materials, either found in nature or manufactured (the "Materials"), by deciphering a series of clues and puzzles.

    (b) There will be ten (10) clues for each Material.

    The ten (10) clues for each Material will be presented only on Facebook, on ten (10) different pages (one page for each Material). Each page on Facebook will be linked to the Contest Home Page. Contestants to do not have to be members of Facebook or log in to Facebook to participate in the Contest.

    (d) Clues may appear in a variety of formats, including, without limitation, word puzzles, photographic clues, video clips and/or links to information which may be located on other online sites.

    (e) Some of the clues for each of the ten (10) Materials will be available at the start of the Contest, with more being added daily throughout the Entry Period until there are a total of ten (10) clues for each Material.

    (f) When a contestant thinks s/he has figured out the identity of one or more of the Materials, the contestant returns to the Contest Home Page where they can input their answer(s) in the form of a word or words that names the Material in question. Answers must be entered into the text box for each Material located on the Contest Home Page.

    (g) There is only one acceptable answer for each Material.

    (h) Contestants will know immediately after submitting an answer if their answer is correct or not.

    (i) Contestants may submit possible answers identifying each Material as many times as they wish during the Entry Period.

  • SELECTION OF WINNERS/JUDGING:

    One (1) Grand Prize Winner: The contestant who is the first to enter the correct answers in identifying all ten (10) Materials during the Entry Period is the "Grand Prize Winner". There may only be one Grand Prize Winner. The Grand Prize Winner is not eligible to be a "Runner-Up Winner", as described below. In the event that no contestant correctly identifies all ten (10) Materials, then there will be no Grand Prize Winner.

    Up to Ten (10) Runner-Up Winners:

    (a) If there is a Grand Prize Winner, the next ten (10) contestants who correctly identify all ten (10) Materials during the Entry Period will each be a "Runner-Up Winner". There may only be ten (10) Runner-Up Winners. In the event that, after the Grand Prize Winner, fewer than ten (10) contestants correctly identify all ten (10) Materials during the Entry Period, then only those contestants who correctly identify all ten (10) Materials will be a Runner-Up Winner; in that case, there may be fewer than ten (10) Runner-Up Winners.

    (b) In the event that no contestant correctly identifies all ten (10) Materials, then there will be no Grand Prize Winner and the criteria for being a Runner-Up Winner will be as follows: the first contestant to correctly identify one (1) of the ten (10) Materials during the Entry Period will be a "Runner-Up Winner". There may only be one Runner-Up Winner with respect to identifying each Material. A contestant cannot be a Runner-Up Winner more than once. If a contestant is the first to correctly identify a Material and that contestant was already a Runner-Up Winner, then the second contestant to correctly identify each such Material will be awarded the Runner-Up Prize for that Material.

    Tie Breaker: In the event that two or more contestants correctly identify all ten (10) Materials and have the same timed-entry during the Entry Period, then, in such event, the Grand Prize Winner and/or the Runner-Up Winner(s), as applicable, will be selected in a random drawing from among all the eligible entries with the same timed-entry received during the Entry Period.

    If there is no Grand Prize Winner and in the event that two or more contestants correctly identify one (1) Material and have the same timed-entry during the Entry Period, then, in such event, the Runner-Up Winner with respect to that Material will be selected in a random drawing from among all the eligible entries with the same timed-entry received during the Entry Period.

    Total Number of Possible Winners: There can only be one (1) Grand Prize Winner and ten (10) Runner-Up Winners selected for the Contest (each, a "Winner"). All Contest Winners will be determined within ten (10) business days from the close of the Entry Period.

  • PRIZES:

    Grand Prize: The Grand Prize Winner will receive a (a) MacBook Air (11-inch, 64GB); (b) a One Hundred Dollar ($100) iTunes gift card; and (c) the opportunity, within three (3) months from WGBH's receipt of the Grand Prize Winner's signed Affidavit and Release Form (see Paragraph 6 below), to hold a video chat of up to 20 minutes in duration with the Host of Making Stuff, David Pogue (the "Video Chat"), who will instruct the Grand Prize Winner on features and applications for the MacBook Air (collectively, the "Grand Prize"). The Grand Prize Winner acknowledges and agrees that the opportunity to have a Video Chat with David Pogue is contingent upon Mr. Pogue's availability for the chat, which is beyond WGBH's control. Upon being confirmed as the Grand Prize Winner, WGBH will provide the Grand Prize Winner with contact information for Mr. Pogue for the purpose of scheduling the Video Chat; however, the Grand Prize Winner is solely responsible for contacting Mr. Pogue and arranging a mutually convenient time for the Video Chat. WGBH is not responsible if Mr. Pogue is not available to hold the Video Chat with the Grand Prize Winner or if Mr. Pogue fails to participate in the Video Chat for any reason. In addition, in the event of illness, act of God, scheduling conflict or any other reason, WGBH is not responsible for the Video Chat portion of the Grand Prize, which has no monetary value, and no alternate prize will be awarded in lieu of the Video Chat and the Video Chat will not be rescheduled.

    Approximate retail value of the Grand Prize is One Thousand One Hundred Dollars ($1,100) and resale is strictly prohibited.

    Runner-Up Prize: Each of the ten (10) Runner-Up Winners will receive an iPod touch (8GB) (the "Runner-Up Prize"). Approximate retail value of the Runner-Up Prize is Two Hundred and Thirty Dollars ($230) and resale is strictly prohibited.

    Grand Prize and Runner-Up Prize (each, a "Prize") Terms and Conditions: WGBH reserves the right to substitute either the Grand Prize and/or the Runner-Up Prize with a Prize of comparable or greater value, at its sole discretion in the event of unavailability.

    Limit: One (1) Prize per person. The Grand Prize and each Runner-Up Prize are not transferable to another person, and may not be exchanged for a different prize or redeemed for cash or any other consideration. WGBH makes no, and disclaims, all warranties, guarantees or representations, express or implied, concerning the condition, quality, merchantability, and/or fitness of the Grand Prize and/or the Runner-Up Prize.

    Any and all federal, state and local taxes, fees and surcharges on Prizes, if any, as well as any other costs and expenses associated with acceptance of the Grand Prize or a Runner-Up Prize and use not specified herein as being provided by WGBH are the sole responsibility of Grand Prize Winner and each Runner-Up Winner, as applicable. WGBH will report any individual winnings over $600 (in cash or fair market value of goods or services) in a one year period to the Internal Revenue Service. Winners will receive a 1099 form from WGBH if WGBH reports any winnings to the Internal Revenue Service.

    Each Winner agrees to the use of his/her/their name(s) and likeness(es) in publicity without notice or any additional compensation, except where prohibited by law.

  • WINNER NOTIFICATION

    Each Winner must accept or decline the applicable Prize via email within thirty (30) calendar days from receiving email notification that they are a Winner. If a Winner is unreachable via email after thirty (30) calendar days, or if a Winner is unavailable for Prize fulfillment, an alternate Winner will be selected.

    Each Winner will be required to sign and return an Affidavit of Eligibility and a Liability/Publicity Release Form, (collectively, the "Affidavit and Release") within thirty (30) calendar days after the Winner receives the Affidavit and Release via email. Failure to return the Affidavit and Release in the time noted will constitute forfeiture of the applicable Prize and an alternate winner may be selected in WGBH's sole discretion.

  • ODDS OF WINNING:

    Odds of winning depend upon the number of eligible entries received.

  • DISCLAIMER OF WARRANTIES / RELEASE LIMITATION ON LIABILITY:

    WGBH is not responsible for any bodily or personal injury, or property damage, or any other loss resulting from use or attempted use of any component of a Prize.

    WGBH is not responsible for entries that are incomplete, illegible, lost, delayed, mutilated or misdirected. WGBH is not responsible for any problems or technical malfunctions, human error, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer online systems, servers or providers, computer equipment, software, failure of entrants on account of technical problems or traffic congestion on the internet or at any website or any combination thereof including, without limitation, losses, damages or injuries to entrant's or any other person's equipment or other property, or to their persons, related to participation in the Contest. In addition, WGBH will not be in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, in connection with the Contest and/or the Prize(s). Although WGBH attempts to ensure the integrity of the Contest, WGBH is not responsible for the actions of entrants in connection with the Contest, including entrant's attempts to circumvent these Official Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of the Contest. The releases hereunder are intended to apply to all claims not known or suspected to exist.

    BY ENTERING THE CONTEST, EACH ENTRANT AGREES THAT: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE CONTEST, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND EACH ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (3) EACH ENTRANT'S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND EACH ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF.

    In the event WGBH is prevented from continuing with the Contest by any event beyond its control, including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within the WGBH's control (each a "Force Majeure" event or occurrence), WGBH shall have the right to modify, suspend, or terminate the Contest.

  • GOVERNING LAW / JURISDICTION:

    All disputes arising hereunder or in relation to the Contest, or the award and/or use of any Prize, shall be brought solely and exclusively in Boston, Massachusetts.
