indenture with Benjamin and Elizabeth Dulany, 1785 February

This
indenture made the twenty first day of february in the year of
our lord one thousand seven hundred eighty five between
Benjamin Dulany of the parish of fairfax and county of fairfax,
farmer and Elizabeth his wife of the one part, and George
Washington of the parish of Truro and county aforesaid farmer
of the other part Witnesseth that the said Benjamin Dulany and
Elizabeth his wife and each of them, for and in consideration
of the sum of five shillings lawful money of Virginia to the
said Benjamin Dulany in hand paid, by the said George
Washington the receipt whereof the said Benjamin Dulany doth
hereby acknowledge, and for and in consideration of a certain
tract of land situate and being in the parish of fairfax and
county aforesaid containing three hundred and seventy six
acres more or less, conveyed to the said Benjamin Dulany by
him the said George Washington and Martha his wife, by
indenture of bargain and sale dated this twenty first day of
february in the year aforesaid, as reference being thereunto
had will more fully and particularly appear; they the said
Benjamin Dulany and Elizabeth his wife and each of them have
granted bargained and sold aliened and confirmed and by these
presents do grant bargain and sell alien and confirm unto the
said George Washington his heirs and assigns forever, all the
lands contained within a patent for five thousand acres
granted by the Lord Culpeper Proprietor of the northern neck
to Colonel Nicholas Spencer and Lieutenant Colonel John
Washington bearing date the first day of march in the year one
thousand six hundred seventy four, situate on Potowmack river
between little Hunting creek and Ipsewassan now commonly
called and known by the name of Dogue creek, whereof Daniel
French late father of the said Elizabeth died seized and
possessed of, by means of sundry purchases by him made from
Richard Osborn, Margaret Arbuthnot executrise of Thomas
Arbuthnot, John Manley, John Posey as by the deeds of
conveyance recorded in the court of fairfax county reference
being thereunto had may more fully and at large appear, and
all houses buildings gardens orchards meadows trees woods
underwoods ways paths waters watercourses profits commodities
hereditaments and appurtenances whatsoever to the said
premisses hereby granted belonging or in any wise appurtaining
and the reversion and reversions remainder and remainders
rents issues and profits [2] thereof and of every part and
parcel thereof (except as herein after excepted and provided)
and also all the estate right title interest use claim and
demand as well in law as in equity of them the said Benjamin
Dulany and Elizabeth his wife and each of them their and each
of their heirs of in and to the said premises and every part
and parcel thereof with the appurtenances; to have and to hold
all the said lands, hereditaments and all and singular the
premisses with their and every their appurtenances unto him
the said George Washington his heirs and assigns for ever
Provided always nevertheless that nothing herein is intended
or shall be construed to affect the estate right title
interest and demand of Penelope French mother of the aforesaid
Elizabeth in & to the hereby granted lands and premisses,
in any wise whatsoever: and
the said Benjamin Dulany and Elizabeth his wife and each of
them, for them and each of them their heirs and singular the
premisses hereby granted or intended so to be, with their and
every their appurtances, unto him the said George Washington
his heirs and assigns, against them the said Benjamin Dulany
and Elizabeth his wife and against their and each of their
heirs and against all and every person and persons whatsoever,
shall and will warrant and ever defend by these presents.
In witness whereof the parties hereunto have to these
presents respectively subscribed their names and affixed their
seals the day and year first above written.

February 1785 This Deed was proved by the oath of William
Payne Charles Lee & Lund Washington to be the act &
Deed of Benjamin Dulany and George Washington and at a Court
Continued and held for the County afd. the 23d. March in the
year af.d. a Commission and return have privy Examination of
Elizabeth wife of the said Benjamin are ordered to be recorded
