A NEW PROJECT AIMED AT CATCHING VIOLATORS AND INCREASING SAFETY COULD START SOON ON OAHU, BUT NOT EVERYONE IS ON BOARD.

WHEN A TRAFFIC LIGHT TURNS YELLOW, DRIVERS ARE SUPPOSED TO SLOW DOWN AND COME TO A STOP.
BUT SOME WILL SPEED UP, TRYING TO RACE THROUGH THE INTERSECTION AND END UP RUNNING THE RED LIGHT.
THIS TYPE OF DANGEROUS ACTION HAS PROMPTED ENFORCEMENT MEASURES BEFORE.

WELL, A NEW RED LIGHT CAMERA PILOT PROGRAM IS SET TO START THIS YEAR ON OAHU.
SO, WHAT’S DIFFERENT?

TEN INTERSECTIONS IN HONOLULU HAVE BEEN PICKED AS TEST SITES BASED ON CRASH HISTORIES AND VIOLATIONS.
THE CAMERAS WILL TAKE A SNAPSHOT OF VEHICLES THAT ENTER AN INTERSECTION AFTER THE TRAFFIC SIGNAL HAS TURNED RED.
A CITATION WILL THEN BE MAILED TO THE REGISTERED OWNER OF THE VEHICLE.
A BILL TO FUND THE PROGRAM IS AWAITING ACTION BY GOVERNOR IGE.
SUPPORTERS SAY IT’S A WAY TO MAKE OUR ROADS SAFER.

JAMES TABE WAS APPOINTED AS THE STATE PUBLIC DEFENDER LAST YEAR AND HAS WORKED IN THE PUBLIC DEFENDER’S OFFICE SINCE 1993.

HE’S BEEN INVOLVED IN HELPING APPROVE LAWS REGARDING COMPLETE STREETS, PASSING BICYCLE RIDERS WITH AT LEAST 3 FEET CLEARANCE AND ENABLING RED LIGHT CAMERAS.

AND I WOULD COMPLIMENT THE PEOPLE WHO SUPPORTED THESE BILLS AND THEY'RE REALLY TRIED TO ADDRESS IN THE FINAL LEGISLATION, SOME OF THE MORE ONEROUS PROBLEMS, INCENTIVE TO THE CONTRACTOR FOR EXAMPLE, AND I THINK THEY'VE DONE THEIR BEST TO MAKE THE PROGRAM MAYBE LESS PAINFUL FOR EVERYONE.
HERE IS THE I GUESS THE COUNTER QUESTION.
$2 MILLION.
HOW MUCH EFFORT CAN $2 MILLION BUY WITH EDUCATION AND POLICE, EXTRA POLICING, EVERY YEAR, THEY HAVE THIS CLICK IT AND TICKET PROGRAM.
FEDERAL MONEY RAINS DOWN.
TRY TO CATCH THE ONE OR 2% OF THE CARS AREN'T WEARING SEATBELTS.
THOSE ARE THINGS THAT MAY BE AT THESE MORE DANGEROUS INTERSECTION, WHERE THEY'RE IDENTIFIED, MAYBE THAT WOULD BE MORE PROACTIVE.
HAVING POLICEMEN ON SITE AND EDUCATIONAL PROGRAMS IN THAT AREA.
FINALLY, I'M A LITTLE SKEPTICAL THAT THESE THINGS WILL EVER COME OUT.
IF THEY'RE INSTALLED, DON'T REALLY WORK, NOT REALLY MAKE MUCH OF AN IMPACT, I WOULD HOPE THAT THEY WOULD BE PULLED OUT.
BECAUSE AT THAT POINT, THEY WOULD JUST BE AN EXPENSE TO THE TAXPAYORS.
THAT'S PRACTICAL QUESTIONS IN THE IMPLEMENTATION.

RED LIGHT CAMERAS ARE ONE TOOL.
EDUCATION IS ANOTHER.
SO WE NEED ALL OF THESE THINGS TO BASICALLY CHANGE BEHAVIOR, SO THAT WHEN YOU SEE A RED LIGHT AS YOU'RE LEAD IN SAID, IMMEDIATE THOUGHT IS SLOW DOWN.
BE PREPARED TO STOP.
TOO MANY PEOPLE TAKE IT YELLOW MEANS I BETTER SPEED UP SO I MAKE THE LIGHT.
AND WHEN THEY RUN THAT RED LIGHT, THEY MAY NOT HIT ANYBODY.
THEY MAY NOT KILL ANYBODY.
BUT THE MORE THAT THAT HAPPENS, EVENTUALLY, THE LAW OF AVERAGES IS GOING TO HAPPEN.
THEN WHEN IT HAPPENS, IT'S GOING TO BE A TRAGEDY.
AND IT MIGHT BE NOT THAT MANY PEOPLE, BUT I THINK THE WAY WE'RE COMING AT IT FROM IS THERE IS NO FAMILY WHO WANTS TO HAVE ONE OF THEIR MEMBERS KILLED BY A SENSELESS RED LIGHT RUNNING CRASH.
THAT'S WHY THE MONEY IS WORTH IT.

SO THEIR TESTIMONY IS REALLY STRONG THAT THEY SUPPORT RED LIGHT CAMERAS.

SO THE LAW BASICALLY, STATED THAT THE REGISTERED OWNER IS PRESUMED TO BE THE DRIVER.
WELL, WE THOUGHT IT WAS UNCONSTITUTIONAL AND DISTRICT COURT JUDGE FOUND IT UNCONSTITUTIONAL BECAUSE YOU'RE PRESUMING SOMEONE COMMITTED THE CRIME.
AND IN OUR COUNTRY, IN HAWAII, YOU'RE RESUMED INNOCENT.
SO YOU SHOULDN'T BE PROVING YOUR INNOCENCE AT THAT POINT.
THAT'S WHY I THINK THE LAW, THAT LAW WAS FLAWED.
THIS LAW AGAIN, TICKET IS GOING TO THE REGISTERED OWNER BUT THEY'RE NOT TARGETING DRIVER PER SE.
THE LAW THE WAY IT'S WRITTEN, IT'S AKIN TO A PARKING TICKET.
SO TICKET IS GOING TO THE CAR.
AND WHOEVER IS RESPONSIBLE FOR THE CAR HAS TO IS LIBEL FOR THE OFFENSE.
TO MAKE SURE IT MAY PASS CONSTITUTIONAL MUSTER, THAT INSURANCE COMPANIES ARE NOT TO USE THIS TO INCREASE RATES.
I THINK OTHER JURISDICTIONS THAT DO THIS HAVE A POINT SYSTEM.

BUT I THINK IT IS FACTUAL THAT MANY, MANY MUNICIPALITIES HAVE PULLED THEM AWAY.

I THINK INSTEAD OF FOCUSING ON THE 20 PERFECT THAT PULLED PROGRAM, FOCUS 80% FOUND IT SUCCESSFUL.
PULL BACK NUMBERS OF THOSE PEOPLE CRASHES THAT SENATOR BROUGHT UP.
PULLED BACK, NOT ONLY PEOPLE IN CRASHES BUT ALSO FATALITIES OF BICYCLISTS AND PEDESTRIANS BECAUSE I DON'T KNOW IF EVERYONE UNDERSTANDS, IN THOSE RED LIGHT RUNNING ACCIDENTS, 55 TO 60% OF THE FATALITIES OCCUR FROM THE BICYCLIST OR PEDESTRIANS OR OTHER DRIVERS.
SO THE THOSE INNOCENT BYSTANDERS THAT GET CAUGHT UP IN ALL OF THIS.
THAT'S WHAT THIS IS ALL ABOUT.
IT'S NOT ABOUT A MONEY GRAB BECAUSE THE FUNDING THAT COMES TO THIS PROGRAM, IN LEGISLATION, GOES DIRECTLY TO THE PROGRAM.
FUNDS THE PROGRAM.
DOESN'T GO ANY OTHER STATE AGENCY.
DOESN'T GO TO ANY COUNTY AGENCY.
GOES TO FUND THIS RED LIGHT PROGRAM.
ALL ABOUT SAFETY.
FOR US, WE'RE HOPING WE DON'T ISSUE ANY CITATIONS ON THIS BECAUSE THAT MEANS EVERYBODY COMPLIED WITH THE LAW.

AND HOPEFULLY, BECAUSE OF THAT, HOPEFULLY PUBLIC CAN BE ASSURED THAT ONLY THOSE THAT GET MAILED OUT ARE TRUE VIOLATIONS.
CAN ALWAYS GO TO THE IF YOU FEEL LIKE YOU WERE RECEIVED TICKET WRONG, YOU CAN ALWAYS WRITE TO THE JUST LIKE OTHER TICKET.
WRITE AND EXPLAIN YOURSELF.
EVEN IF YOU WERE WRONG, YOU COULD ASK FOR MITIGATING CIRCUMSTANCES WHERE THE FINES CAN ACTUALLY GET REDUCED OR TICKET ACTUALLY GETS DISMISSED.
JUST BECAUSE YOU GET A TICKET IN THE MAIL DOESN'T MEAN YOU'RE JUST GUILTY AND HAVE TO PAY THE FINE.

SO TO ME, COMMITTEE AND LEGISLATURE INCORPORATED BEST PRACTICES FOR THE LAST 30 YEARS IN RED LIGHT RUNNING IN THE UNITED STATES.

IF THE YELLOW LIGHT IS ADJUSTED, I WOULD TRUST THAT THERE IS GOING TO BE A PUBLIC AWARENESS SO THAT PEOPLE CAN ADJUST TO THE YELLOW LIGHT BEING SHORTER OR LONGER.
BECAUSE IT WOULD BE TERRIBLY UNFAIR TO GET A TICKET BECAUSE SUDDENLY, THAT YELLOW LIGHT THAT YOU DRIVEN THROUGH FOR 20 YEARS IS SHORTER.
SO COMMENT ON THAT.
AND AS FAR AS THE MONEY, FUNDS THAT ARE GOING TO BE GENERATED BY THIS, WE WOULD BE FOOLISH TO DENY IT'S GOING TO MAKE MONEY.
