The scuffle that went viral on social media shows Z'Kye Husain, a Black teen being pinned down and handcuffed by police while the white teen involved was seen seated on a couch.
The incident drew national attention after allegations of racial bias surfaced.
Neither teen was ever charged for the fistfight, but officials banned both boys from the mall for three years.
An attorney for Husain filed a complaint against Bridgewater Township, claiming negligence and discrimination, asking for more than $100,000.
The family is scheduled to appear in court on January 30th for a settlement hearing.
