6 protesters are still seeking answers.
The group known as the Broad View 6 faced criminal charges for allegedly interfering with the federal immigration agents.
Vehicle.
But in a surprising twist, all charges were dropped amid allegations of misconduct by federal prosecutors.
Today a judge held a hearing to consider whether to name a special prosecutor to investigate what defense attorneys are calling a cover up by the U.S.
attorney at Masterson joins us now with more.
Matt, what did the judge decide today?
Brand essentially the judge ruled that the fallout from his botched prosecution is going to continue.
There was not a ruling today on whether or not a special prosecutor is going to be appointed to investigate this alleged misconduct.
>> But Judge April Perry today decided that she wanted to conduct additional fact-finding into what exactly went on in the U.S.
attorney's office throughout the prosecution of this case, there's been widespread allegations of misconduct by spot prosecutors ahead of the grand jury and that they attempted to cover that conduct up before Judge Perry and the court itself.
So Perry wants to get to the bottom of this.
That means this process is going to play out for weeks or months further.
>> What facts will Judge Perry be looking for in order to make a decision on how to proceed in this case?
The specifics of that have not exactly been laid out yet.
There's going to have to be some briefing on what specifically she wants to get to the bottom of that.
>> But she has said that it's very clear mistakes were made in this clip.
In this case, prosecutors made inaccurate statements.
She'd wouldn't go as far as calling those lies just yet.
She didn't want to make that finding.
But she said that prosecutors need to make clear what exactly did happen if they did mislead the court.
And if they did so intentionally, that could lead to the appointment of a special prosecutor or some sort of contempt charges down the road.
U.S.
Attorney Andrew Boutros or his attorneys will fully cover up when his lead the court about what exactly went on during prosecution of this case.
Is there any precedent for a case like this that might indicate how she might decide?
It's an exceedingly unusual position for the Northern District Illinois.
The prosecutors here to find themselves and that prosecutors, the one who bring charges, they're not the ones who are the subject of a potential criminal investigation into their own conduct.
Much of Thursday's hearing today was spent figure out exactly the path ahead of who could serve as a special prosecutor and how exactly they would be allowed to investigate.
So.
Parties on all sides seemed a little unclear about how to move forward with this as it is such an unusual position.
But as defense attorney said afterwards, this is that Perry's decision today to move forward with inquiry shows that no one is above the law.
Last week, assistant U.S.
Attorney Sherry Mecklenburg, she retired so that she could defend herself.
Does that spell any guilt and how she or U.S.
Attorney Andrew handled this case?
Not guilt specifically, but it should shed more light on what exactly went on during these grand jury proceedings.
Mecklenburg is the one who was accused of this alleged misconduct.
She allegedly.
>> Vouched for the specific for the strength of the case.
She excuse skeptical grand jurors.
She met grand jurors outside of the proceedings which is all.
>> His conduct is not allowed to happen and she had sought to defend herself against these allegations.
But as a member of trusses office, she was told she's not allowed to do so.
That's why she She now wants to make her case clear.
She says she's being scapegoated.
So now she's going to be pointing the finger back at Boutros and potentially leading more credence that there was some sort of cover up.
>> What happens once the request of facts are presented and a decision is made.
Judge Perry is going to decide if a special prosecutor is necessary to investigate any of this potential wrongdoing.
So that could lead to that appointment or she could decide not to it, which would basically mean that this case is over.
The criminal charges have already been dismissed.
>> So if she does decide to move forward to the prosecutor, there could be further inquiry.
There could be criminal contempt charges against prosecutors are potentially Andrew Boutros himself or there could be other sort of sanctions that are determined by the special prosecutor by Lot of questions going forward.
Matt Masterson, thank you.
Experience.
