COMING UP THIS WEEK, ATTORNEY GENERAL BROWN ON THE FOOD AID CUTOFF AND FEDERAL IMMIGRATION RAIDS.
AND THE ARTIFICIAL INTELLIGENCE REVOLUTION.
BUT FIRST TONIGHT, WE FOCUS ON THE 3800 MARYLAND YOUNG PEOPLE IN FOSTER CARE.
A MONTH AGO ONE OF THEM DIED.
16-YEAR-OLD WAS FOUND DEAD IN A BALTIMORE HOTEL.
SHE HAD BEEN HOUSED BY THE STATE DEPARTMENT OF HUMAN SERVICES.
THE MEDICAL EXAMINER RULE TO DO A SUICIDE.
SHE WAS SUPPOSED TO HAVE BEEN UNDER SUPERVISION BUT WAS ALONE AT THE HOTEL AT THE TIME OF HER DEATH.
STATE OFFICIALS TESTIFIED AT A HEARING CALLED TO DISCUSS NUMEROUS AUDIT DEFICIENCIES AT THE AGENCY.
>> MY HEART IS BROKEN OVER THIS DEATH AND I ASK MYSELF EVERY SINGLE DAY IF WE HAVE MOVED FASTER ON ANY NUMBER OF ISSUES WOULD THIS PRECIOUS LIFE STILL BE ALIVE?
AND EVERY SINGLE DAY I AM ON THIS TABLE WHO REVIEWS THE UGLY PART OF HUMANITY AND THE REASON WHY CHILDREN WHO SUFFER ARE EXPERIENCING FOSTER CARE IN THIS STATE.
AND I'VE ALWAYS SAID MY LIFE AND CREER WHICH I'VE DEDICATED THIS WORK I HAVE NEVER MET A CHILD EXPERIENCING FOSTER THAT SAID YES, SIGN ME UP.
THEY WANT TO BE LOVED AND RAISED IN A FAMILY.
GOVERNMENTS CAN NOT AND SHOULD NOT RAISE CHILDREN.
>> Jeff: JOINING US NOW ARE TWO MARYLAND LAWMAKERS WITH PERSONAL EXPERIENCES IN FOSTER CARE.

DELEGATE GRIFFITH IF I CAN START WITH YOU, TELL US A LITTLE BIT ABOUT YOUR EXPERIENCES?
>> SURE.
WELL, I WENT INTO FOSTER CARE WHEN I WAS 12.
MY FATHERS WITH A DRUG DEALER I WAS RAISED BY MY GRANDMOTHER WHO PASSED AWAY.
AND AFTER THAT HAPPENED MY DAD SPLIT.
I ENDED UP IN THE FOSTER CARE SYSTEM.
AND CERTAINLY COMPARED TO CHAIRMAN WILSON'S EXPERIENCE MY EXPERIENCE WAS NOT NEARLY AS BAD AS HIS.
BUT WITH THAT BEING SAID, THERE'S CHALLENGES BEING IN FOSTER CARE, NO ONE IS IN FOSTER CARE BECAUSE OF A GOOD EXPERIENCE.
THERE WERE LEVERS AND BUTTONS PUSHED TRYING TO KEEP ME IN LINE.
THREATS OF GOING TO GROUP HOMES.
BECAUSE ANYBODY IN THAT SITUATION, ANY YOUNG PERSON IN THAT SITUATION IS NOT GOING TO BE REACTING OR ADAPTING PERFECTLY WELL.
SO ANYTIME THAT I WOULD BE NORMAL 13 OR 14 OR 15-YEAR-OLD KID, DEALING WITH THE EXPERIENCES THAT LED ME THERE, AND YOU START TO ACT OUT THE SOCIAL SERVICE SYSTEM WOULD SAY IF YOU DON'T BEHAVE WE ARE GOING TO PUT YOU IN A GROUP HOME WHICH MEANT 30 YEARS AGO THEY KNEW THAT GROUP HOMES WERE A BAD DEAL.
AND THIS ALL HAS SHOWN THAT THAT HASN'T CHANGED SINCE MY TIME IN THE FOSTER CARE SYSTEM.
>> Jeff: CHAIR WILSON YOU HAVE BEEN OPEN ABOUT THE ABUSE YOU SUFFERED AS A FOSTER CHILD.
WHATEVER YOU WANT TO SHARE IN THIS CONTEXT ABOUT THAT.
ALSO YOUR THOUGHTS ON THE WARD CASE?
>> I THINK THAT I HAD A HORRIBLE EXPERIENCE IN THE SYSTEM, I'D CALL IT PLACED MULTIPLE TIMES IN 13 FOSTER HOMES AND GROUP HOMES AND FINALLY PLACED WITH A SEXUALLY ABUSIVE FOSTER AND ADOPTED PARENT.
SO HORROR STORIES AND I THINK THAT IT IS A VERY HEARTBREAKING TO KNOW THAT THE THINGS HAVEN'T CHANGED MUCH.
BUT I WILL SAY I'M NOT SURPRISED.
BECAUSE WHEN I RAN NOBODY TALKS ABOUT FOSTER CHILDREN.
WE TALK ABOUT CHILDREN EVERY FOUR YEARS WHEN IT'S TIME TO RUN FOR OFFICE.
AND THEN AFTER THAT WE NEVER HEAR ABOUT FOSTER KIDS AGAIN.
THAT WHY I STARTED THE FOSTER YOUTH DAY IN ANNAPOLIS SO THEY CAN FOLLOW THEIR DELEGATES AND REMIND THEM THEY EXIST.
NOT ONLY GIVE THEM A VOICE IN THE FUTURE YOU NEVER KNOW WHEN YOU ARE GOING TO LEAVE.
MAKE SURE THEY HAVE SUITCASES INSTEAD OF TRASH BAGS.
AND THEY CAN START GOING TO COLLEGE AT THE AGE OF 26.
UP UNTIL THIS BIG BILL THEY WERE ALLOWED TO GET FREE HEALTHCARE UNTIL THEY WERE 26 YEARS OLD AS MY CHILDREN DO.
AND NOW THANKS TO THIS VACCINATION THAT IS NO LONGER A THING BUT WE'LL GET INTO THAT AS WELL.
>> Jeff: YOU HAVE PREFILED LEGISLATION ON THIS SUBJECT FOR THE SESSION THAT STARTS IN JANUARY.
>> YES.
SO WE'RE INTRODUCING A BILL AFTERWARD WHO TRAGICALLY TOOK HER LIFE WHILE IN THE FOSTER CARE SYSTEM IN THE HOTEL WITH LIMITED SUPERVISION WITH UNLICENSED THIRD PARTY PROVIDING SERVICES FOR HER.
MAKE SURE THE FOSTER KIDS CAN NOT BE KEPT IN UNLICENSED SETTINGS WHO INCLUDE HOTELS AND HOMELESS SHELTERS SOME KIDS ARE BEING PUT IN HOMELESS SHELTERS AND BACKGROUND CHECKS ARE BEING CONDUCTED SO WE'RE NOT PUTTING FOSTER KIDS IN WITH SEXUAL OFFENDERS AS HAPPENED UP TO SEVEN TIMES.
AND ONE OF THE THINGS IT CREATES INSPIRE BAD BY DELEGATE WILSON'S BILL IT CREATES AN OMBUDSMAN TO CREATE OUTSIDE OVERSIGHT OF THE DEPARTMENT TO MAKE SURE THESE THINGS ARE BEING APPLIED.
GRATEFUL TO INTRODUCE THAT BILL 10 YEARS AGO AND IT IS A BIG INSPIRATION TO CREATE THIS OVERSIGHT.
>> Jeff: DO YOU THINK THE SPHERE WILL SUPPORT PASSING SOME LEGISLATION NEXT YEAR?
>> WITHOUT A DOUBT AND I HOPE WE GET TO LOOK AT IT.
I SUPPORT THE SPIRIT OF THE BILL AND I WANT TO MAKE SURE PEOPLE UNDERSTAND HAVING BEEN IN THE FOSTER CARE SYSTEM AND I AM A DEFENSE ATTORNEY AND WORK FOR THE PUBLIC DEFENDERS OFFICE WHEN IT COMES TO REPRESENTING THE FOSTER YOUTH.
THE KIDS KIDS IN HOTELS WE WOULE TO SAY ALL ARE UNWANTED BY PARENTS OR UNABLE TO TAKE CARE OF THEM MANY SUFFERED HORRIBLE ABUSE AND WITNESSED VIOLENCE AND TRAUMA.
AND MOST FOSTER PARENTS ARE LOOKING FOR AN ADDITION TO THE FAMILY NOT SAVE A YOUTH.
IT'S HARD TO PLACE THEM.
AND THE PROGRAMS WE'VE SETUP WE HAVE BEDS FOR, THE PROBLEM IS THERE ARE A LIMITED NUMBER OF PEOPLE TO TAKE CARE OF A LIMITED NUMBER OF CHILDREN AND LIMITED IN THE CAPACITY YOU CAN DO THAT.
IF YOU ADD CHILDREN HOUSED IN HOTEL ROOMS THESE ARE CHILDREN THAT RUN AWAY, CRIMES OF VIOLENCE, SEXUAL ABUSERS, PHYSICAL ABUSERS AND IT'S DIFFICULT TO PLACE THEM.
I WORK WITH THE CHILDREN.
IT'S CHALLENGING.
OF COURSE THE HOTEL IS NOT THE OPTIMUM SETTING BUT KNOWING THESE PROGRAMS ARE LEGALLY RESPONSIBLE FOR ONCE THEY TAKE THEM IN AND THEY GIVE THE DEPARTMENT 72 HOURS TO PICK THE KIDS UP THAT THEY CAN'T HANDLE THEM.
FINDING SOLUTIONS FOR THOSE TRAUMATIZED KIDS MAKING SURE THEY ARE HELD ACCOUNTABLE FOR THEIR ACTIONS AND UNDERSTANDING NOT EVERYBODY IS GOING TO FIT INTO THE MOLD IS SOMETHING WE HAVE TO LEARN TO DO.
WHEN THE KIDS BECOME TEENAGERS MANY OF THEM ARE AT OF AT BEST ANGRY, AT WORST -- AND IT GETS WORSE AND WE HAVE TO MAKE SURE WE ARE COGNIZANT OF THAT THESE ARE THE WARDS OF OUR STATE AND WE SHOULD BE DOING FOR THEM.
>> Jeff: WHERE SHOULD THEY BE?
WHAT SHOULD THE STATE BE DOING MAYBE SHOULD BE DOING EARLIER TO PREVENT SOME OF THESE SITUATIONS, BUT ONCE YOU HAVE THE SITUATION AND IT SOUNDS LIKE THERE'S WONDERFUL FOSTER PARENTS BUT MAYBE NOT ENOUGH.
AND NOT PREPARED TO TAKE ON SOME OF THE SITUATIONS.
WHAT SHOULD WE DO?
>> JEFF, A COUPLE OF THINGS.
FIRST AND FOREMOST WHILE I AGREE WITH CHAIR WILSON, AND SOME SHORT-TERM SITUATIONS WHERE THESE HAPPEN YOU HAVE KIDS IN HOSPITALS AND HOTEL ROOMS FOR UP TO TWO YEARS.
YOU HAVE KIDS PLACED IN HOMELESS SHELTERS.
YOU HAVE KIDS LIVING IN THE DSS BUILDING IN BALTIMORE.
SO EVEN SOME OF THESE SITUATIONS WHERE YOU HAVE A KID UNDER DURESS FOR A KID TO BE LEFT IN THE SITUATION FOR TWO YEARS THERE IS NO WAY TO JUSTIFY THAT.
BUT SOME OF THE SOLUTIONS IS, AGAIN, WE HAVE A 67 BILLION DOLLAR BUDGET.
RIGHT?
FOR A STATE OF SIX MILLION PEOPLE.
YOU CAN'T CONVINCE ME THAT OVER THE LAST 30 YEARS WE COULDN'T HAVE CARVED OUT TO CREATE MORE OPPORTUNITIES AND MORE FACILITIES AND WRAP AROUND SERVICES FOR CHILDREN LIKE WARD WHO WAS KNOWN TO BE SUICIDAL WOES MOM PUT HER BACK INTO THE SYSTEM BECAUSE SHE WAS AFRAID FOR HER LIFE AND DID NOT HAVE THE RESOURCES AT HOME TO SAVE HER.
AND SHE PUT HER BACK INTO THE CARE OF THE STATE TO TRY TO SAVE HER LIFE.
AND THE STATE FAILED HER CATASTROPHICALLY.
AND WE KNEW THE STATE KNEW HER SITUATION AND STILL PUT HER IN A RELATIVELY UNSUPERVISED UNSAFE SITUATION FOR A GIRL IN HER SITUATION.
>> Jeff: WHAT DO WE NEED MORE OF?
MIKE, YOU SAID THAT THE GROUP HOME WHEN YOU WERE A YOUNG MAN WAS HELD OVER YOUR HEAD AS A BAD THING.
IS THERE A WAY TO DO THAT RIGHT?
>> ABSOLUTELY.
IT TAKES INVESTMENT AND AGAIN AS SOMEBODY A SMALL GOVERNMENT GUY I DON'T THINK YOU THROW MONEY AT PROBLEMS AND IT DOES AWAY.
BUT THIS IS SOMETHING YOU CAN INVEST IN AND TAKE THAT MONEY WE HAVE IN THE 67 BILLION BUDGET AND INVEST IN CREATING PROPER FACILITIES WITH TRAINED PROFESSIONALS, WITH A PROGRAM WITH SAFETY IN MIND.
WE CAN CREATE THIS AND INVEST IN THE GOOD FOLKS THAT ARE DOING THIS WORK AND MAKE SURE WE'RE BEING CRITICAL OF THE FOLKS THAT ARE NOT PROVIDING PROPER SERVICES LIKE WE SAW IN THE SITUATION IN BALTIMORE WHEN IT RELATES TO WARD.
ABSOLUTELY WE CAN MAKE INVESTMENTS AND CREATE FACILITIES THAT ARE PROPER FACILITIES.
>> Jeff: I HAVE A MINUTE BUT IF THERE IS AN OPPORTUNITY THAT COMES OUT OF THIS TRAGEDY, YOU KNOW, THE TIME IS NOW.
THIS NEXT LEGISLATIVE SESSION.
WHAT WOULD YOU WANT TO SEE?
>> WITHOUT A DOUBT WHAT MY COLLEAGUE IS SPEAKING ON IS VERY IMPORTANT.
WHAT I WANT TO SEE THAT SAME STICK TO IT TONESS IF WE HAVE TO RAISE TAXES.
THE CHILDREN ARE LOSING MEDICAID BENEFITS BECAUSE OF THIS ADMINISTRATION.
POVERTY PUSHES CHILDREN INTO FOSTER CARE.
THE HOME ENERGY ASSISTANCE.
TAKING A WOMAN'S RIGHT AWAY TO CHOOSE WE HAVE UNWANTED CHILDREN IN THE FOSTER CARE.
I HOPE MY COLLEAGUE STAYS WITH THIS WHEN IT COMES TIME TO FUND AND TAKE CARE OF THE CHILDREN.
FREE LUNCHES AND BREAKFAST FOR PEOPLE IN SCHOOL.
ONCE THEY GET INTO FOSTER CARE WE NEED TO FUND THEM.
IF WE TALK ABOUT TOO MUCH TAXES THAT IS THE FIRST THING TO CUT.
NOBODY REMEMBERS THAT.
I DO HOPE DEARLY THAT THE COLLEAGUES ON THE OTHER SIDE REMEMBER THESE CHILDREN ARE WORTH SAVING.

BEFORE WE GET TO THAT, YOU'RE SUING THE TRUMP ADMINISTRATION ARGUING THAT THE CUTS TO S.N.A.P.
BENEFITS ALSO THROWN AS FOOD STAMPS ARE UNLAWFUL.
WHAT IS THE CASE THERE?
>> SURE.
AND S.N.A.P.
SUPPOSE SUPPOSE, THAT FEEDS CLOSE TO 700,000 MARYLANDERS, CLOSE TO 3,000 -- 300,000 OF OUR CHILDREN.
THESE ARE FAMILIES WHO RELY IN LARGE PART ON THIS FEDERAL BENEFIT FOR THEIR NUTRITIONAL NEEDS.
WITHOUT WHICH THEY WOULD BE WHAT WE CALL FOOD INSECURE.
WE ARE IN A FEDERAL SHUT DOWN BUT CONGRESS ACCOUNTED FOR THAT.
CONGRESS APPROPRIATED $6 BILLION FOR THE NATION SO THAT IF AND WHEN THE FEDERAL GOVERNMENT SHUTS DOWN AS IT IS RIGHT NOW, THAT FOOD SUPPORT, ASSISTANCE WOULD CONTINUE.
YET, WHAT WE HAVE IS A TRUMP ADMINISTRATION WITHHOLDING THAT.
THE DEPARTMENT OF AGRICULTURE, U.S.
DEPARTMENT OF AGRICULTURE, AND IT'S WHAT WE CALL ARBITRARY THEY WOKE UP AND SAID WE'RE GOING TO DISCONTINUE FUNDING THAT IS UNLAWFUL.
>> Jeff: YOUR TEAM HAS BEEN PREPARING LEGAL ADVICE FOR LOCAL LAW ENFORCEMENT ACROSS MARYLAND ON INTERACTIONS WITH FEDERAL IMMIGRATION OFFICERS.
WHAT ARE THE BIG ISSUES THERE?
>> JUST TO CLARIFY, THIS IS THE SECOND SET OF GUIDANCE THAT THE OFFICE OF THE ATTORNEY GENERAL PUT OUT.
MY PREDECESSOR PUT OUT A FEW YEARS AGO I REVISE IT AND UPDATED THE GUIDANCE WHERE WE TALKED ABOUT MARYLAND'S LAW ENFORCEMENT COMMUNITY AND THE RESTRICTIONS WHEN IT COMES TO IMMIGRATION ENFORCEMENT.
THAT WAS MONTHS AGO.
WHAT WE RECENTLY ISSUED, WAS GUIDANCE TO LAW ENFORCEMENT MARYLAND LAW ENFORCEMENT WHEN THEY INTERACT WITH FEDERAL LAW ENFORCEMENT FOR ANY PURPOSE.
AND THAT COULD BE WHETHER IT IS A MUTUAL AID AGREEMENT, WHETHER THEY ARE BEING CROSS DESIGNATED WITH FEDERAL AGENTS A TASK FORCE WHICH HAPPENS EVERYDAY, REMINDING MARYLAND LAW ENFORCEMENT YOU ARE GOVERNED BY MARYLAND LAW AND NOT WHAT YOU MIGHT SEE FROM YOUR COUNTERPARTS YOUR FEDERAL AGENTS OR YOUR FEDERAL COUNTERPARTS.
>> Jeff: NOW, A REPUBLICAN STATE'S ATTORNEY IN ONE MARYLAND COUNTY RESPONDED TO THAT EARLIER OPINION FROM YOUR OFFICE, SAYING THAT IT'S NOT BINDING ON LOCAL LAW ENFORCEMENT.
SO WHO IS IN CHARGE?
WE HAVE FEDERAL OFFICERS, WE HAVE A STATE ATTORNEY GENERAL, AND WE HAVE LOCAL COUNTY OFFICIALS.
>> WHAT IS BINDING IS MARYLAND LAW.
FOR EXAMPLE, MARYLAND LAW ENFORCEMENT THEY ARE REQUIRED TO WEAR BODY WORN CAMERA AND REQUIRED TO IDENTIFY THEMSELVES WHEN THEY MAKE A STOP.
WE'VE SEEN EXAMPLES OF FEDERAL LAW ENFORCEMENT OFTEN I.C.E.
AGENT AS WHO ARE REFUSING TO IDENTIFY THEMSELVES AND WEARING MASKS.
THIS GUIDANCE REMINDS MARYLAND LAW ENFORCEMENT THAT MARYLAND LAW PROHIBITS THAT.
SO THE GUIDANCE ITSELF IS NOT INTENDED TO BE A BINDING DOCUMENT.
BUT IT STATES TO MARYLAND LAW ENFORCEMENT WHAT MARYLAND LAW IS.
>> Jeff: IS THERE ANYTHING IN MARYLAND LAW THAT WOULD PROHIBIT FEDERAL OFFICER OR A LOCAL OR STATE OFFICER FROM THAT MATTER, FOR THAT MATTER FROM APPEARING IN PLAIN CLOTHES AND WEARING A MASK?
WE SEE PLAIN CLOSED OFFICERS, F.B.I.
IS GENERALLY PLAIN CLOSED BUT THEY ARE NOT WEARING MASKS.
>> MARYLAND DOES IT FOR LAW ENFORCEMENT TO IDENTIFY THEMSELVES MANY LOCAL DEPARTMENTS SHERIFFS AND POLICE HAVE POLICIES ABOUT WEARING MASKS OR NOT.
AND POLICIES REGARDING PLAIN CLOTHES.
WHAT WE ARE NOT SEEING THUS FAR WHICH IS GOOD, ARE VIOLATIONS OF THOSE POLICIES.
WE'RE NOT SEEING MARYLAND LAW ENFORCEMENT GOING AROUND AS MASKED AGENTS.
WE ARE SEEING THAT WITH FEDERAL AGENTS.
AS WE ANTICIPATE, STATE LAW ENFORCEMENT, LOCAL LAW ENFORCEMENT WORK WITH THE FEDERAL COUNTERPARTS THIS IS A REMINDER YOU CANNOT ALWAYS DO WHAT YOU SEE THEM DOING.
>> Jeff: IF ONE OF THESE INTERACTIONS ONE OF THE CONFLICTS RESULTS IN AN ASSAULT, IS THE FEDERAL OFFICER IN ANYWAY POTENTIALLY LIABLE IN THE STATE OF MARYLAND AS A CRIMINAL MATTER OR A CIVIL MATTER.

I WILL SAY THERE ARE FEDERAL AGENTS AS WELL AS STATE LAW ENFORCEMENT ARE SUBJECT TO CIVIL LIABILITY IF THEY, EXCESSIVE FORCE, CONSTITUTIONAL NORMS AND STANDARDS FOR CONDUCT.
