A Superior Court judge this week issued a temporary restraining order against what's being called disruptive picketing outside the New Brunswick facility.
The judge sided with the hospital in issuing the order after an emergency meeting on Monday, where RWJ officials argued the picketers blocked entrances and parking garages, intimidate other employees and obstruct busses, carrying the replacement nurses filling in.
The judge agreed the nurses conduct can be considered unlawful acts because it interferes with essential emergency and medical services.
The president of the nurses union, meanwhile, calls the allegations a fabricated union busting tactic.
The union on Tuesday refused the hospital's latest contract offer because they said it didn't meet the staffing demands.
A hearing is set for Friday morning when the judge will decide whether to issue a preliminary injunction on the strike.
While the contract negotiations play out.
