The U.S. Department of Agriculture told states last week that it had until tomorrow to hand over the data for those enrolled in the program, saying that data will help the department combat waste, fraud and abuse.
The lawsuit, led by the attorney General of California, says states fear the sensitive data will be used to create a surveillance system to advance the president's mass deportation efforts.
The lawsuit is seeking an injunction to block that data transfer.
Agency officials have threatened to withhold Snap funding if states failed to comply.
