The ruling came from Franklin County Circuit Judge Phillip Shepherd.
House Bill nine called for diverting funds from local school districts to fund charter schools.
And his ruling judge, Shepherd, said the law creates a separate and unequal system of charter schools that does not meet the constitutional requirements for public schools.
Kentucky's House Democratic Caucus leaders said they were not surprised by the ruling, and they said they're prepared to keep making their case if funding for charter schools again becomes an issue in the upcoming legislative session.
