16 cars came off the track late last week near Livingston.
Sulfur from two of the cars then caught on fire.
CSX, who operated the train, said a failed Wilbur was the cause of the accident.
Now, the legal firm Morgan and Morgan has filed a lawsuit claiming the accident was preventable.
The plaintiffs are asking for punitive damages, damages related to emotional distress, loss of property value and more.
In a statement, the company says CSX is reviewing the allegations in the lawsuit.
