IS NOT BEING PUNISHED TO THE FULLEST EXTENT.
>>> BUT THE GOVERNOR CAN ONLY CONVENE A COURT MARSHAL IF THE GUARD ASKS HIM TO DO SO.
ERIC HOLCOMB SAYS HE HAS NEVER BEEN ASKED TO.
LISA IS A SEXUAL ASSAULT SURVIVOR AND SHE SAYS THAT INFORMATION IS SHOCKING.
>> IF YOU'RE WANTING TO ADD THE GENERAL TO THE CONVENING AUTHORITY AND THE REASON THAT YOU GIVE IS BECAUSE THE GOVERNOR HAS NOT BEEN CONVENING COURT MARSHALS AND THEN THE INFORMATION COMES OUT THAT YOU HAVEN'T REQUESTED ANY COURT MARSHALS TO BE CONVENED THAT'S CONCERNING.
>>> THE GUARD DECLINED TO EXPLAIN DESPITE LEADERS SAYING CASES SHOULD BE HAND THAT WAY.
WHY IS THE GUARD BEING SO EVASIVE ON THIS ISSUE?
IT'S THE FIRST QUESTION FOR OUR INDIANA WEEK IN REVIEW PANEL.

I'M INDIANA PUBLIC PUBLIC BROADCASTING STATE HOUSE CHIEF BRANDON SMITH.
ELISE, IS THIS THE IS PROBLEM OF THE GUARD'S OWN MAKING?
>> YES AND I THINK THAT'S MAYBE WHY WE SHOULD TAKE A PAUSE, THAT WOULD BE MY SUGGESTION, BECAUSE I THINK A LOT OF FOLKS ARE UNCLEAR WHY THIS IS HAPPENING, WHAT IT WOULD MEAN.
THE MOST CONSISTENT ANSWER THAT'S BEGUN GIVEN FOR THE COURT MARSHAL PIECE IS POTENTIAL ABUSE WHICH IS NOT EVIDENCE BASED.
THIS PIECE OF LEGISLATION HAS BROUGHT ABOUT WAY MORE ISSUES, AND IT AFFECTS A LOT OF DIFFERENT FOLKS INCLUDING NATIONAL GUARDS PEOPLE SO I THINK WE CAN TAKE A PAUSE SO WE CAN FIGURE OUT WHAT A GOING ON HERE.
I THINK A LOT OF PEOPLE ARE UNCOMFORTABLE WITH WHERE IT IS NOW.
>> WE TALKED ABOUT THIS BILL AND THERE ARE TWO PARTS.
ONE IS THE GOVERNOR'S AUTHORITY TO CALL A COURT MARSHAL.
NOBODY HAD A PROBLEM WITH TAT, THE OTHER PART PEOPLE WERE CONCERNED ABOUT IS THE IDEA OF TAKING AWAY THE POWER OF A NATIONAL GUARD MEMBER TO ASK FOR A COURT MARSHAL.
THE PROBLEM EVERYONE AGREED TO IS ALSO PROBLEMATIC BECAUSE THE ANSWER IS THE GOVERNOR IS IMPEDIMENTS TO THIS.

>> THERE'S A LITTLE BIT OF THIS GOING ON, FINGER POINTING AT EACH OTHER.
I THIS THE PROBLEM WITH THIS -- THEY'RE TRYING TO EXPAND THE AUTHORITY OF THE NATIONAL GUARD TO RESOLVE AND INVESTIGATE THESE SITUATIONS.
THAT'S GREAT AMOUNT.
THEN LEFT UNRESOLVED BECAUSE NO SUB IS ONE IS TALKING TO EACH OTHER OR THEY HAVE LIMITED RESOURCES.
I THINK THIS LEGISLATURE WOULD BE MORE THAN WILLING TO INVEST IN THE NATIONAL GUARD TO HELP IF THEY ASKED FOR THAT PART OF IT INSTEAD OF THE PROCESS CHANGES BUT GO FIGURE THAT IT.
THE PROBLEM IS THAT CREATES A CULTURE THAT IS NOT HELPFUL EITHER.
IF PEOPLE IN THE GUARD -- IF THESE GUYS KNOW WHAT'S GOING ON, THESE GUARDS MEN KNOW WHAT'S GOING ON INSIDE THEIR OWN RANKS AND YOU COMPLAINT LET THIS LINGER AND CREATE THIS CULTURE NOTHING IS RESOLVED AND WE TAKE AWAY DUE PROCESS AND NO ONE HAS ACCESS TO.
>> THAT CREATES A PROBLEM WITH RECRUITING NEW GUARD MEMBERS WHICH I THINK THE STATE SHOULDN'T BE DOING THING ECS TO DISCOURAGE THAT, SOMETHING THAT AL STRUCK ME THOUGH, TO WHAT MIKE JUST TALKED ABOUT WHICH ON THE SENATE IN WEEK THAT BILL WAS DEBATED A COUPLE TIMES, AND NOW IT'S ON THE GOVERNOR'S DESK AND I'M FASCINATED TO SEE WHAT HE DOES WITH IT ALTHOUGH I'M GUESSING HE'LL JUST SIGN IT.
BUT FUNCHAL THE REASON WE HAVE TO GET RID OF THIS DUE PROCESS RIGHT, WELL UNDER THE CAN YOU REMEMBER CURRENT SYSTEM ANYBODY WILL ASK FOR A COURT COURT MARSHAL AND WE CAN'T DO THEM BECAUSE ALL THEY HAVE TO DO IS ASK FOR A COURT MARSHAL AND IT WILL GO AWAY.
ISN'T THAT A PROBLEM THAT NEEDS TO BE SOLVED?
>> ONE WOULD THINK.
THERE ARE A LOT OF ISSUES GOING ON HERE AND IF YOU WANT TO GET BROAD IT'S THE CHALLENGE OF DEALING WITH ISSUES SUCH SUCH AS SEXUAL ASSAULT WHEN YOU'RE TALKING ABOUT INSTITUTIONINGS THAT HAVE OPERATED OUT OF PUBLIC SCRUTINY FOR GENERATIONS AND I'M TALKING ABOUT ALL BRANCHES OF THE MILITARY, I'M TALKING ABOUT CORPORATIONS BUT WE SEE IT TIME AND TIME AGAIN.
CNN THIS WEEK WAS LOOKING AT COAST GUARD ENFORCE.
IN TERMS OF THE MERCHANT MARINE AND THEY HAVE DONE ZERO IN THE LAST DENGUE INDICATE EVEN THOUGH THERE HAVE BEEN NUMEROUS ALLEGATIONS AND SEEMINGLY VALID ALLEGATIONS, SO WE STRUGGLE AS A SOCIETY TO DEAL WITH THESE THINGS IN THE RIGHT WAY.
AND THE GENERAL ASSEMBLY IS NOT ACAN YOU SAY TOLL -- ACCUSTOMED TO DEALING WITH MILITARY ISSUES.
THESE ARE PROFESSIONAL SOLDIERS, THESE ARE THE MEN AND WOMEN WE ENTRUST WITH OUR SAFETY AND SECURITY AND I THINK IT'S FORCING THE GENERAL ASSEMBLY TO EXERCISE MUSCLES THAT HAVE ATROPHIED.
>>> AND THAT GETS BACK TO ISN'T THIS THE PROBLEM OF THE GUARD'S OWN MAKING IS THIS.
>> THIS MIGHT BE AN ISSUE BUT WE DON'T KNOW BECAUSE THERE'S NO DATA, THEY HAVEN'T TOLD US HOW MANY MAJOR AND MINOR OFFENSES THERE HAVE BEEN, THEY HAVEN'T TOLD US HOW MANY NONJUDICIAL PUNISHMENTS HAVE BEEN MEETED OUT AND IT TOOK US ALMOST THREE MONTHS TO FIND OUT THAT THEY HAVEN'T ASKED FOR A COURT MARSHAL EVEN FROM THE GOVERNOR, SO I HAVE NO DOUBT IT'S GOING TO GET SIGNED INTO LAW BUT I THINK THERE ARE A LOT OF BIG REMAINS QUESTION, HOW HAS THE GUARD BEEN OPERATING FOR DECADES WITHOUT EWING COURT MARSHALS.
>>> MORE THAN A DOZEN INDIANA LAWMAKERS HAVE CONSULTANT JOBS ACCORDING TO A STORY THIS WEEK AND THE IS IT RULES ABOUT DISS CLOSING CONSULTING CLIENTS DON'T ALWAYS PROVIDE FOR MUCH TRANSPARENCY.

RULES ONLY RATHER LAWMAKERS TOLY THE CLIENTS THEY CONSULT FOR IF THEY'RE A SIGNIFICANT SOURCE OF INCOME MEANING SOME LAWMAKERS DO AND OTHERS DON'T.
THE STORY MENTIONS DEMOCRATIC REPRESENTATIVE BLAKE JOHNSON WHO DIDN'T LIST HIS CLIENTS ON HIS ADDITION CLOSURE FORM BECAUSE ACCORDING TO JOHNSON HE DIDN'T THINK TO DO SEW WHEN THE FORM DIDN'T PROMPT IT.
MIKE O'BRIEN WE'VE TALKED ABOUT THE STRENGTHS AND WEAK NETSES OF A CITIZEN LEGISLATURE AND THERE'S ALWAYS THE IDEA OF A CONFLICTED OF INTEREST WHICH IS YES THE REASON I HAVE THAT BILL IS BECAUSE I KNOW WHAT I'M TALKING ABOUT WHEN IT COMES TO THAT INDUSTRY.
DOES THIS GO BEYOND THAT PROBLEM THOUGH?
>> I THINK THE ADVANTAGES ARE YOU HAVE AN INSURANCE AGENT INFORMING THE LEGISLATURE ON INSURANCE POLICIES, YOU HAVE A TEACHER INFORMING THE LEGISLATURE ON EDUCATION POLICY, OTHERWISE YOU HAVE AN INSURANCE AGENCY IN FRONT OF THE LEGISLATURE ON EDUCATION POLICY AND A TEACHER ON LEGISLATION POLICY AND STYLE THAT ENRICHES -- ABOUT UNDERSTANDING WHAT ARE THE POLICY DECISIONS AND HOW THEY IMPACT THE WORLD AND THE LEGISLATURE ALMOST BENEFITS FROM HAVING PEOPLE FROM ALL WALK OF LIFE WHERE THE ONLY THING THEY'RE DOING IS NOT BEING A LAWMAKER, THAT'S NOT THE MOST IMPORTANT THING IN THEIR LIFE AND I THINK THAT BENEFITS.
BUT IT ALSO REQUIRES ADDITION CLOSURE OF WHAT YOU'RE DONSBACH IN OTHER PARTS OF THE LIFE AND I THINK THE MOST CONSISTENT THEME IS LIKE BLAKE JOHNSON, DIDN'T OCCUR TO ME, THEY ASKED ME TO FILL OUT THIS FORM AND IT NEVER OCCURRED TO ME TO GO TWO LAYERS DEEPER THAN THAT.
SO IT'S IMPORTANT TO LOOK AT HOW DEEP DO WE REQUIRE PEOPLE TO DISCLOSE.
I HAVE TO ADDITION CLOSE A LOT IT'S A HUGE BURDEN.
IF I BUY A HOT DOG I HAVE TO REPORTS IT, SO THERE'S A LOT OF TRANSPARENCY IN THE SYSTEM BUT IT'S ALWAYS WORTH TAKING A LOOK.
>> BUT WE'RE SAYING IT'S ONE THING TO SAY I'M AN INSURANCE AGENT, I'M A TEACHER, THAT'S PRETTY OBVIOUS.
WHEN WE'RE TALKING ABOUT CONSULTING JOBS, I'M A CONSULTANT, WHO DO YOU CONSULT FOR IN I DON'T HAVE TO TELL YOU.
>> THAT'S THE THE MAINTAINWAY OF THIS PIECE AND I THINK IT WAS GREAT REPORTING AND IT'S A TEXT BOOK EXAMPLE OF WHY WE NEED TO BE SUPPORTING THIS WAS A DEEP DIVE.
IT AFFORDED LEGISLATORS TO TALK DEEPLY ABOUT WHY THEY FILL THINGS OUT THIS WAY: IT UNDERSCORED IF A FORM DOESN'T HAVE CERTAIN DISCLOSURES IT WILL PUSH DISCIPLINING PUBLIC POLICY IN A CERTAIN DIRECTION AND IT INFORMS THE DISCUSSION WE NEED TO HAVE AND I DO THINK WE NEED TO HAVE IT THE BECAUSE WE HAVE A SUPER IMBALANCED LEGISLATURE.
COULD THEY BE?
SO HAVING THIS CONVERSATION IS REALLY IMPORTANT AND I'M THANKFUL FOR THE PIECE.
>> SO WE TALKED TO TODD HUSTON YESTERDAY ABOUT THE PIECE AND HE SAID WE NEED TO BE LOOKING AT OUR TRANSPARENCY PROCESSES TO BE IF THEN BE IMPROVED AND HE POINTED TO THE ETHICS COMMISSION, IT IS A SUPER MAJORITYING REPUBLICAN LEGISLATURE BUT NOT ON THE ETHICS COMMITTEES, THOSE ARE SPLIT DOWN THE MIDDLE.
SO THIS WORK THAT NEEDS TO BE DONE?
>> I THINK IT'S A FEW EASY FIXES.
SOMEBODY COULD BE PUSHING A BILL OR BLOCKING A BILL FOR A CLIENT, YOU WOULD NEVER KNOW.
SO IT'S AN EASY FIX AND I DO WANT TO GIVE CREDIT TO SPEAKER HUSTON, ONE OF THE REASONS WHEN WE WERE LOOKING THROUGH ALL THESE WE NOTICED HI STARTED HIS ON.
HE ACTUALLY PUT DOWN HIS OWN CLIENTS AND WE DIDN'T KNOW THEY WERE HIS CLIENTS BECAUSE THERE'S NO PLACE TO PUT THEM ON THE FORM.
SO IT LOOKED LIKE ANOTHER BUSINESS HE HAD AN INTEREST IN, SO HE WENT OUT OF THE WAY TO DO THAT AND SOME MEMBERS ARE DOING IT AND SOME MEMBERS AREN'T.
>> TALKING TO LEGISLATORS THEY MADE THE ARGUMENT THAT WE WERE ALSO MAKING WHICH WILL GO MORE TRANSPARENCY ESPECIALLY ON THIS SORT OF THING, JUST MAKES THE SYSTEM BETTER.
>> TRANSPARENCY IS AUTOPSY GOOD WHEN YOU'RE TALKING ABOUT GOVERNMENT'S INTERACTION WITH DEMOCRACY.
LOOKING BACK TO THE CLASSIC CASE, CITIZENS UNITED WHERE ANTHONY KENNEDY SAID THIS WILL BE GREAT BECAUSE THERE'S GOING TO BE ALL THIS TRANSPARENCY, WELL THE REASON PEOPLE ARE STILL GROSSING ABOUT THAT DECISION AND SAYING IT'S THE WORST THING THE SUPREME COURT DID IS THERE IS NO TRANSPARENCY AND SOME OF THE DARK MONEY THAT FLOWED, SO THERE IS A PROBLEM.
I THINK LAWMAKER JUDGE WANT GENERALLY WANT TO DO THE RIGHT THING, BUT A YEAR AGO CAPITAL CHRONICLE DID NOT EXIST, HEAVEN FORBID SO HAD YOU NOT CREATED THIS VALUABLE INSTITUTION, THIS ENTITY WE WOULDN'T KNOW THAT, SO THAT SHOWS PERHAPS SOME HAVE A JILLTY IN THE SYSTEM.
>>> INDIANA IS CLOSER THAN EVER TO PUTTING SPEED CAMERA THIS IS A FEW HIGHWAY CONSTRUCTION ZONES ACROSS THE STATE.
A BILL TO CREATE A PILOT PROGRAM IS A COUPLE STEPS AWAY INTEREST THE GUN VIOLENCE'S DESK.
>> THE PILOT WOULD SET UP CAMERAS IN FOUR HIGHWAY WORKSITES.
DRIVERS WOULD BE TICKET IF THEY GO 11-MILE-AN-HOUR OTHER THE LIMIT ONLY WHEN WORKERS ARE PRESENT AND CHAD SCOTT SAYS WORKERS NEED THAT PROTECTION.
ONE OF HIS WORKERS WAS KILLED A FEW YEARS AGO AND HE TOLD THE IS SENATE COMMITTEE AHEAD HE HAD TO DELIVER THAT NEWS TO HIS WIFE.

>> ONCE WE GET THE YOUNG KITS OUT THERE AND THEY HAVE A NEAR MISS THEY'RE NOT COMING BACK.
>> THE BILL IS HEADED FOR THE SENATE FLOOR.
>> WE TALKED ABOUT THIS, THE IDEA SOME ISSUES TAKE A LISTENING TIME TO GET TO THE MEASURE LINE.
IS THIS A PERFECT EXAMPLE OF ONE THAT NEEDED THAT?
>> I THINK THAT IS PROBABLY MORE TYPICAL, WE SEE CERTAIN ISSUES WHERE THERE'S SOME BIG EXPLOSION IN TERMS OF PUBLICITY AND OUTRAGE BUT I DON'T SEE THAT ANYBODY'S EVER CHARTED THIS BUT I'M GUESSING ON THESE ISSUES THAT ARE THE AS PRESSING YOU'RE GOING TO HAVE SEVERAL YEARS AGO AND PART OF IS BECAUSE PEOPLE LIKE TO HAVE THESE WORTHWHILE DISCUSSIONS BUT WHAT IF?
WHAT IF SOMEBODY IS BUYING MY CAR, WHAT IF SOMEBODY IS DOING THIS AND THERE ARE ALWAYS THOSE WHAT IF SCENARIOS THAT NEED TO WORK THROUGH AND THOSE TAKE TIME.
THERE'S ALWAYS GOING TO BE THAT BIG BROTHER LURKING THING, ANYTIME YOU HAVE A CAMERA THERE'S A PROBLEM.
>>> WE TALKED LAST WEEK ABOUT THE SLIPPERY SLOPE ARGUMENT AND I THINK THERE'S A LOT OF VALIDITY TO THAT ARGUMENT.
IT'S ALSO AN ARGUMENT YOU HEAR ON THIS ISSUE A LOT WHICH IS LISTEN, A FEW CAMERAS, EVEN IN THE SENATE COMMITTEE THIS WEEK, YES, BUT MY GOD WE'RE NOT GOING TO PUT CAMERAS AT RED LIGHTS IN INDIANA AND THAT'S A LOT OF PEOPLE'S HESITATION ON THIS BILL THAT.
A VALID CONCERN?
>> IT IS A VALID CONCERN BECAUSE THERE ARE LOTS OF WAYS TO USE TECHNOLOGY THAT LAWMAKERS AREN'T COMFORTABLE WITH.
HAVING SAID THAT, LET'S BE HONEST, THIS BILL HARDLY DOES ANYTHING.
THE FOUR PLACES IN THE STATE YOU CAN PUT CAMERAS, YOU HAVE TO BE GOING HE'S 11 OVER, IT DOESN'T EVEN GIVE YOU A TICKET.
IT'S SO FAR DOWN I DON'T KNOW THAT IT'S GOING TO HAVE AN IMPACT.
>> BUT WHAT I DO THINK IT WILL HAVE AN IMPACT ON IS OUR OVER ALL I GUESS WAY THAT WE LOOK AT INFRASTRUCTURE IN KEEPING PEOPLE SAFE BECAUSE IT'S KIND OF A NO BRAINER TO KEEP CONSTRUCTION WORKERS SAFE.
AND THIS IS APARTMENT BUILDING PART OF THE LARGER VISION ZERO ISSUE AND THIS IS NOT JUST ABOUT CONSTRUCTION WORKERS, WE ARE WOEFULLY BEHIND ON KEEPING PEDESTRIANS SAFE AND CYCLERS SAFE SO IF WE CAN START HERE, IT IS A LONG PROCESS, START HERE BUT HAVE START TO INFORM THE TEXTURE OF THIS PARTICULAR LANDSCAPE, I THINK IT'S A PILOTMENT THERE'S GOING TO BE THINGS WE NEED TO LOOK AT BUT I THINK IT'S A GOOD START AND I HOPE IT OPENS UP A MORE CONVERSATION ON THIS.
>> ONE THING TOO THOUGH THINKING ABOUT THE LONG-TERM FUTURE OF DO WE GO -- ONCE WE DO THE PILOT PROGRAM DO WE SPREAD IT TO MORE SITES OR PUT CAMERAS IN DIFFERENT PLACES.
LAWMAKERS HAVE TALKED FOR YEARS ON THIS BILL ABOUT HOW THEY AND THEIR CONSTITUENTS COMPLAIN TO THEM ABOUT HOW THEY GOT A TICKET IN THE MAIL FROM SOMEWHERE THEY'VE NEVER BEEN.
