A transgender Kentucky inmate is suing the state's Department of Corrections for denying her hormone therapy.
That is now banned under state law.
Madeline Markham is serving a 40 year prison sentence for a 2013 murder.
She says she was diagnosed with gender dysphoria and 20 0, 9, and has been receiving treatment since 2016.
But Senate bill 2 passed during the 2025 Kentucky General Assembly prohibits gender affirming care for inmates.
Marr comes federal pass action lawsuit was filed by the ACLU of Kentucky.
It claims that SB 2 violates the U.S. Constitution's 8th amendment prohibiting cruel and unusual punishment and the 14th Amendment guaranteeing equal protections.
At least one state lawmaker is criticizing the lawsuit on social media.
Republican state representative TJ Roberts said he was honored to vote for Senate Bill 2.
He added, quote, I want to be very clear.
There is nothing compassionate about forcing the people of Kentucky to pay for transgender drugs for a convicted murderer or for anyone for that matter, rather forcing the taxpayer to front the cost of affirming the mental illness of a murder is cruel and unusual treatment of the people of Kentucky,
