Former assistant US attorney, county prosecutor discusses what 'target letter' means
Former President Trump said on Tuesday that he received a so-called target letter from Special Counsel Jack Smith, that focused on his efforts to overturn the 2020 election results. The target letter seemed to cite, according to The New York Times, a potential charge of conspiracy to defraud the U.S. and a broad charge tied to a violation of rights.

Learn Moreabout PBS online sponsorshipthe former president's legal struggles continue to pile up just yesterday Trump said that he received a so-called Target letter from special counsel Jack Smith which focused on his efforts to overturn the 2020 election results the target letter seemed to cite according to a number of news outlets potential charges including conspiracy to defraud the U.S violation of Rights and tampering with the witness victim or informant at a Fox News Town Hall last night Trump referred to the letter as election interference I don't think they've ever sent a letter on Sunday night and they're in a rush because they want to interfere it's interference with the election so could a Third Federal indictment become Trump some have suggested that a Target letter usually means an indictment will follow joining me to help us understand the letter and what ramifications additional charges may have on this presidential run is Chris Gramiccioni former assistant U.S attorney for New Jersey and former Monmouth County prosecutor Chris thanks for joining me great to be with you thank you so former president Trump says he's received a Target letter what even is a target letter so Target letter in when a prosecutor or a federal prosecutor has substantial evidence that apparently links an individual or an organization to criminal activity that's being investigated by a Federal grand jury normally what will happen is that the doj or the prosecutor will send a letter to the Target or through Council most likely indicating that he or she is a target of these a particular criminal activity and oftentimes it's accompanied by an invite to come and testify before the grand jury and to top all that off the backdrop is this is quite unprecedented having a you know a former president and a current presidential candidate that Target of a grand jury investigation supplies we're kind of breaking a new ground here right and and that goes into my next Point how does this all square up for Trump considering he's been indicted in New York for hush money payments and in Florida for classified documents evidence recorded here in Bedminster I mean what do you think it's a good question I mean I couldn't opine on how it might affect him politically I can tell you just anybody who's facing potential charges in various jurisdictions it's a difficult Endeavor but if I was uh his counsel I'd be focused mostly on that because these these charges if charges are ultimately brought they they carry with it not only the the penalties that come with a conviction but you know difficulty of potential imprisonment or otherwise so I think um when you get a Target letter you're a defense attorney and you get one on behalf of a client um the first decision you have to make is are you going to make your client available to testify and if you do that witness will be read his Miranda rights and he'll be an under oath and subject to you know perjury and obstruction of justice the alternative in most cases what happens is through Council will indicate to the prosecutor that the client is going to assert his Fifth Amendment rights and then the grand jury will at some point decide without the testimony of that Target so how about this how about this on that note Trump's lawyers appealed to the Miami judge and the documents case just yesterday to postpone an August trial date because of the pending election is there president for that not that I know of um because there's no precedence in uh you know a presidential candidate being the target of an investigation as far as I know or in this case in the case you're referring to a defendant invest in a criminal prosecution so whether that's good cause to adjourn a case I guess that judge will have to decide there's Myriad other factors that could support good cause to extend or continue a case and with the complexities and that prosecution you're referring to the the challenges and ensuring people get uh clearances to be able to review classified material that in and of itself lends itself to probably you know continuance or adjournment in that proceeding but if you're asking just in the vacuum of he's a presidential candidate therefore you should put this you should continue this I I haven't seen anything that in in precedence that would allow for that well I guess we could soon know more about another possible Federal indictment for former president Trump thank you so much Chris Gramiccioni for joining me thank you
