(crowd chatting indistinctly) (gavel knocking) Good afternoon and evening, everyone.
Welcome to our pre-Thanksgiving City Council Business Agenda for Tuesday, November 22nd.
I will now call the meeting to order.
We have no special presentations this evening, and we'll take a motion on the minutes.
Minutes have the motion for approval.
There's a second to that motion that will stand without objection.
Ordinances on final read.
Counsel has no objections.
We will take A, B, and C as a package, Madam Clerk.
- [Clerk] Item A.
An ordinance to amend Chattanooga City Code, Part II, Chapter 38, Zoning Ordinance, so as to rezone a portion of a property in an unaddressed block of Fringe Road, from UGC, Urban General Commercial Zone, R-T/Z, Residential Townhouse, Zero Lot Line Zone, and C-2, Convenience Commercial Zone, with conditions to R-T/Z Residential Townhouse, Zero Lot Line Zone and C-3 Central Business Zone, with conditions.
Item B.
An ordinance to amend Chattanooga City Code, Part II, Chapter 38, Zoning Ordinance, so as to rezone property located at 3102 10th Avenue from M-1 Manufacturing Zone to R-2 Residential Zone.
Item C. An ordinance to amend Chattanooga City Code, Part II, Chapter 38, Zoning Ordinance, so as to rezone property located at 3402 4th Avenue from R-1 Residential Zone to R-T/Z Residential Townhouse, Zero Lot Line Zone.
Item D. An ordinance closing and abandoning a sanitary sewer easement located in the 1900 Block of Northpoint Boulevard, tax map number 100P-C001, as detailed on the attached map, subject to certain conditions.
Item E. An ordinance closing and abandoning a sanitary sewer easement located in the 2500 Block of Gunbarrel Road, tax map numbers 149A-B-007, 016, and 017.01, as detailed on the attached map.

(papers rustling) - [Clerk] A resolution approving and authorizing the execution of an Interlocal Cooperative Agreement, Reimbursement Agreement, with the Sports Authority of the city of Chattanooga and Hamilton County as to interim expenses.

A resolution confirming Mary Kelly's appointment of Vickie Haley as the city of Chattanooga's interim city finance officer.
Effective December 1, 2022.
Item C. Resolution confirming Mary Kelly's appointment of Phillip Noblett as the city of Chattanooga's interim city attorney.

Purchases this evening.

We have three purchases this evening.
We have one sole source to report.
We have no emergency purchases, and I believe no RFPs.

- So we have three purchases.
The first is Fleet Management Division and Public Works' purchase of one Ford Transit T250 LR Crew, with Tommy liftgates for the Chattanooga Fire Department.
Two bids were received, and the award goes to Ford of Dalton, and the amount of $53,120.
Next, from Facilities Division of Public Works, new blanket contract for HVAC services.
Four bids were received, and the award goes to Mountain City Services Inc., Quality Mechanical Group Inc., and W.J.
O'Neal Company.
This will be a four-year contract with the combined annual amount not to exceed 2 million.
And lastly, from the Waste Water Division of Public Works, new blanket contract for MSA safety parts.
Two bids were received and the award goes to Gexpro DBA GE supply.
This will be a four-year contract with the annual amount not to exceed $50,000.

The Air Pollution Control Bureau completed a sole source procurement from Teledyne API, the sole manufacturer of the T640 Mass Monitor to replace the Continuous Mass Monitor at the Siskin Drive site.
The amount of the purchase was $27,104.
This is a report only to council.

We're now moving into recognitions of persons wishing to address the counsel.
If you'd like to address the counsel, please do so here at the podium.
And while you're coming, I will have the city attorney read our rules for public speaking.
- [Attorney] At the end of every council meeting, the chair will recognize members of the public that wish to address the council.
Here's your rules.
Each speaker wishing to address the council can be recognized only upfront at the microphone for that purpose.
You can't have more than three minutes to speak.
You can only address the council upon matters that are within their legislative and quasi-judicial authority, and not on matters that are under the authority of other regulated bodies, or governmental bodies, or agencies.
You can't use any vulgar, obscene language, nor use the floor to personally attack or personally denigrate others.
Address your comments to the council as a whole and not make comments directed towards individual council members.
You can only do so one time a day at this meeting, and don't engage in disorderly conduct or disrupting a public meeting, which is prohibited by Tennessee law.
A person commits that offense, if a person substantially obstructs or interferes with the meeting by physical action or verbal utterance, with the intent to prevent or disrupt a lawful meeting.
Having said to all those rules, sir, go right ahead and tell us what you're here about.

- Okay.
My name is Ron Thomas, and thank you, council members, for having me here.
- [Attorney] Yes.
- And I live on Lower Mill Road in Hixson, and my issue is with the garbage containers.
The garbage trucks consistently replace the garbage cans.
I would estimate about 50% of the time, partially in the roadway on Lower Mill Road.
I assume it's the same throughout the city.
I don't know that for a fact, but my request is that the drivers be trained to place the empty garbage containers back so they're not partially on the road, anywhere in the city of Chattanooga.
My personal experience on October the 19th, the Wednesday.
At about 4:15 PM, I swerved over from the center line to miss an oncoming car, and I heard a loud noise.
I didn't know what I hit.
I stopped to examine my car, found out my rearview mirror on the passenger side was damaged, was crunched and destroyed.
Cost me $450 to fix that, file a claim with the city, which has been denied.
But, I would request that you would follow up with my request and that the citizens of Chattanooga not be exposed to unnecessary risk caused by the city garbage trucks and containers.

Oh, Mr. Thomas, you're in Lower Mill Road, you said Hixson area?
- [Ron] Yes, sir.
So that would be Councilman Ken Smith's district.
- [Ron] Right.
I left a message.
- Right.
- [Ron] But I haven't heard back from anybody.
I did call the Public Works, and let them know about it, but I thought I would let y'all know as well, as I probably won't get any recourse on my $450, but they shouldn't be leaving the garbage cans partially in the road.
- Okay.

- My name's Kyle Sanders.
I'm in your district, Darren.
- [Chairman] Yep.
(Kyle coughing) The reason why I'm here today is about me bending my wheel to my motorcycle, which is a BMW S 1000, which is a $30,000 motorcycle.
I purchased it brand-new at Pandora Motorsports, and I had bent the wheel to it on Rossville Boulevard.
I had made a claim with the city.
The city had never even reached back out to me.
I also made a phone call, and nobody ever called me back, but that's why I'm here.
And then also, if anybody drives down Rossville Boulevard, realizes how dangerous that road is for motorcycles, seeing how many drive down that road on a day-to-day basis.
Now, I know four years ago, they were fixing a new sidewalk down Dodds Avenue, and they never even fixed Dodds Avenue, but they put a sidewalk in.
I have no idea why, but that's what you guys are for.
So, but I appreciate you guys' time, and if you can, I would love for you guys to pay for my wheel, because it is a $2,500 wheel.
It's not a cheap wheel.
- [Chairman] And you haven't heard a response from the city yet?
I'm, I'm gonna, - Zero.
- [Chairman] I'm gonna have you turn around, and Ms. Strong, can you, can you help out, to make sure we get a response, or to make sure that we're addressing Mr. Sanders' claim, and, and his, what he has put in for the city.
If you'll turn right around, she'll raise her hand.
