Welcome to our Tuesday, September the 14 City Council agenda.
I now call this meeting to order.
All right, moving now into ordinances final reading, Madam Clerk, 5A please?
- (Madam Clerk) An ordinance here and after also known as the fiscal year 2021 through 2022 operations budget providing revenue for the fiscal year beginning July 1, 2021 and ending June 30, 2022.
Appropriating same to the payment of expenses of the municipal government fixing the rate of taxation on all taxable property in the city, and the time taxes and privileges are due, how they shall be paid, when they shall become delinquent, providing for interest and penalty on delinquent taxes, and privileges, amending Chattanooga city code part 2, chapter 2 section 2 to 67 relative to paid leave for active duty training, and to amend Chattanooga city code part 2, chapter 31 sections 31-36, 31-37, 31-41, and 31-43 sections 31-322 and 31-354, and to accept and appropriate federal funds for the fiscal year activities from the state and local fiscal recovery funds provided in the American rescue plan act.

Ready to go, second reading committed to the pay raises.
We get a notation from Nashville saying, that when we advertised for the public hearings we didn't use the correct language in the advertisement and we would run the risk of perhaps our budget being rejected.
And for that I said, "Oh no.
We're committed, our budget isn't gonna be rejected.
We're gonna fix it, so that we can meet our commitments to our employees.
So what I'm doing, is I'm deferring the 2nd reading till the 28th.
On the 28th I hope you're all here, because we're gonna follow the same process that we did before.
And that is, from 3:00 to 5:00 we'll be online, and from 5:00 to 8:00 we'll be in person.
- (Chairman Henderson) 6:00 - (Councilwoman Berz) Excuse me, 5:00 to 6:00.
6:00 to 8:00 - (Chairman Henderson) 6:00 to 8:00 - (councilwoman Berz) I'm so glad I have the Chair here, to correct me.
(laughing) - (Councilwoman Berz) Male prerogative - (Chairman Henderson) We won't (inaudible) - (Councilwoman Berz) The problem is, that we're committed to doing things right, and I'm not gonna let us risk not getting the tax dollars for the pay raise.
Okay?
It's just that simple.
And if there's a possibility that in Nashville our budget would not get approved, that's not acceptable.
So, to ensure that it get approved, what we're doing is re-doing the public hearing relative to the tax part.
You'll see in the paper, we posted it today, in the paper tomorrow, you'll see the notice.
And we're doing it again so we will have met the requisites of Nashville, and we will not risk losing any ability to give you the pay you so richly deserve.
So I found out earlier that there were some people spreading some false information, it's totally false.
I believe that you got a letter from the Chief of Staff explaining our commitment, and I apologize for any discomfort that you may have, but it wasn't of our making.
If anyone has any questions I'm sure you can bring them up at the end today, when we have public comment.
And I'll be happy to answer them for you.
But please rest assure that anything we do is to protect the tax issues, so that the pay raises are intact and are protected.
And I'll be happy when this is over to take any questions.
For those of you who are spreading incorrect information, don't do that.
That's small minded.

We've moved to 6 conditions in order to make this project a reality and provide additional housing opportunities in our area.
And I wanna thank the applicant and the engineer for working with the community, and I believe even as going to their homes over the weekend to make sure their questions and concerns were met.
And we've came up with these 6 conditions, so I wanna thank you all for that, that cooperation.

The conditions are, number 1 maximum density shall be 168 units for the development.
Number 2 no vehicular access to Pinewood Drive.
Number 3 a 25 foot landscape buffer shall be constructed along the shared Southern and Eastern boundaries of the development, and shall required meeting the Type A landscape requirements, And 4, a minimum 40 foot building setback as measured from the shared Souther and Eastern boundaries of the development shall be required.
5, Developer to install a minimum 5 foot high vinyl coated chain link fence along the Southern and Eastern property boundaries of the development.
6, The maximum height of any building in the development shall be 2 stories or 30 feet.

And number 2, auto oriented uses, adult oriented establishments, self storage, self-service storage facility, wholesaling with accessory warehousing, hospitals, shall be prohibited.
